HomeMy WebLinkAbout020766 ORD - 09/05/1989AN ORDINANCE AUTHORIZING THE RENEWAL OF THREE YEAR LEASE AGREEMENTS WITH THE PADRE LITTLE -SENIOR LEAGUE FOR THE USE OF A TRACT OF LAND AT THE HOLLY ROAD WATER RESERVOIR SITE ANG FCR THE USE OF A TRACT OF LAND AT SOUTH GUTH PARK FOR YOUTH SPORTS PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager is hereby authorized to execute two lease agreements with the Padre Little -Senior League the first for the use of a tract of land at the Holly Road water reservoir site and the second for the use of a tract of land at South Guth Park for youth sports purposes, providing for terms of three years and such other conditions as more full set forth in the lease agreements, substantial copies of which are attached hereto and made a part hereof, marked Exhibit A and B. 2OSRPIO0.ord 20766 MICROFILMED PADRE LITTLE -SENIOR LEAGUE LEASE AGREEMENT South Guth Park THE STATE OF TEXAS COUNTY OF NUECES This Lease made and entered into this the Y�-i, day of 1989, by and between the City of Corpus Christi, Texas, a municipa corpor- ation, hereinafter called "City", and the Padre Little -Senior League, Corpus Christi, Texas, hereinafter called "Lessee". WITNESSETH That the City, for and in consideration of the sum of one dollar ($1.00) Leases the following pieces or parcel of Premises located in Nueces County, Texas, being more particularly described as follows: BEING a rectangular tract of land out of Lots 8 and 19, Section 17, Flour Bluff and Encinal Farm and Garden Tracts as recorded by plat in Vol. "A", Pages 41, 42, and 43, Map Records of Nueces County, Texas and being more particularly described by metes and bounds as follows: Beginning at a 1" iron pipe in the East right-of- way line of Nile Drive that bears S 60 degrees 58' 50" E, 60.0 Feet and No 29 degrees 01' 10" E, 146.48 feet from the most Westerly corner of said Lot 19; THENCE, S 60 degrees 58' 50" E, a distance of 375 feet to a 1" iron pipe for a corner; THENCE, S 29 degrees 01' 10" W, a distance of 348.48 feet to a 1" iron pipe for a corner; THENCE, N 60 degrees 58' feet to a 1" iron pipe line of Nile Drive for a 50" W, a distance of 375 in the East right-of-way corner; THENCE, N 29 degrees 01' 10" E, along the East right-of-way line of Nile Drive, a distance of 348.48 feet to the place of beginning; Containing three (3) acres of land more or less, "Premises". The term of this Lease shall be three (3) years beginning 1989 and ending September 4, 1992, and subject to the following conditions. 1. Lessee does by these presents and by entering upon agree to maintain the Premises throughout the year in a clean 1 September 5, covenants and the Premises and sanitary condition, and at the expiration thereof to return said Premises to City in as good condition as received, reasonable use, wear, acts of God, fire and flood damage and destruction excepted. 2. Lessee does by these presents and by entering upon the Premises agree that no additions or alterations shall be made to the Premises without the prior written consent of the Park and Recreation Department. Lessee further agrees that the City's Park and Recreation Department shall have joint use of the Premises during the term hereof, subject to the right of the Lessee to have exclusive control during Padre Little -Senior League activities. Lessee further agrees that the City may use said Premises when needed by the City or needed to be crossed by the City for the installa- tion of utility or effluent easements and/or lines without compensation to Lessee for such easements or damage caused by installation, maintenance, removal or repair of said utility or effluent lines. 3. Lessee does by these presents and by its entry upon the Premises agree to use said Premises for the establishment and maintenance of a recrea- tional area for the benefit of the public with primary use being the aforesaid League program and for no other purpose without prior written consent of the Director of the Park and Recreation Department. 4. Lessee does hereby agree to pay for all utilities used by it on the said Premises or used by any other activity sponsored by Lessee on said Premises. 5. Lessee hereby agrees to conform to all rules set out by the City Manager and/or the Park and Recreation Advisory Committee of the City for the maintenance of the said Premises. 6. Lessee does hereby agree to promptly execute and fulfill all of the ordinances of the City pertaining to health and sanitation, and to execute and fulfill all ordinances, orders and requirements imposed by the Health, Sanita- tion, Fire and Police Departments, for the correction, prevention and abate- ment of nuisances and/or hazards in, upon, or connected with the operation of a ball park on said Premises during the term of this lease at Lessee's own expense. 7. Lessee does hereby agree that the City shall not be responsible for damages to property or injury to persons which may arise incident to the exercise of the rights and privileges herein granted. Lessee further agrees to indemnify and hold the City harmless from any loss or damage that may occur upon said Premises which loss or damage arises by reason of or is in any way connected with Lessee's use of said Premises. Lessee shall fully indemnify, save and hold harmless the City of Corpus Christi, its officers, employees, and agents (hereinafter "the Indemnitees") against any and all liability, damage, loss claims, demands and actions of any nature whatsoever, on account of personal injuries (including, without limitation on the foregoing, workers' compensation of death claims), or property loss or damage of any kind whatsoever, which arise out of or are in any manner connected with, or are claimed to arise out of or be in any way connected with, the performance of this Agreement, regardless of whether such injury, loss or damage shall be caused by, or be claimed to be caused by, in whole or in part, the negligence 2 or other fault of the Indemnitees or any of them. Lessee shall at its own expense investigate all such claims and demand, attend to their settlement or other disposition, defend all actions based thereon and pay all charges of attorney and all other costs and expenses of any kind arising from any such liability, damage, loss, claims, demands, and actions. 8. The City hereby agrees that Lessee may at the end of the term of this Lease remove it at its own expense any and all improvements placed on said Premises by Lessee which are unattached to the Premises and which may be removed without damaging the Premises. 9. Lessee further agrees to use a portion of said tract for parking purposes. Lessee shall be responsible for maintenance and construction of dust -free parking areas and maintaining suitable entrance and exit roads, properly designated, in accordance with standards set out by the Director of Park and Recreation. 10. Lessee shall secure and maintain throughout the term of this Lease, at its own expense, comprehensive general insurance in the amount of ONE HUNDRED THOUSAND DOLLARS ($100,000) for bodily injury or death to any one person, FIVE HUNDRED THOUSAND DOLLARS ($500,000) for bodily injury or death for any one occurrence, and TWENTY THOUSAND DOLLARS ($20,000) for property damages per person and ONE HUNDRED THOUSAND DOLLARS ($100,000) for property damages per occurrence. Said policy shall name the City as an additional insured, and a certificate of said policy shall be furnished the City and maintained throughout the term of this Lease. City must be notified in writing thirty (30) days prior to cancellation, non -renewal or material change in said insurance policies. 11. Lessee must maintain a current list of officers on file with the Park and Recreation Department through the term of the Lease. 12. Lease will have a cancellation clause --either party may terminate the Lease with 60 days notice. 13. This Lease contains all the provisions agreed upon by the parties hereto and displaces all previous verbal or oral agreements.
