AUTHORIZING THE EXECUTION OF AN EASEMENT AND RIGHT OF WAY
AGREEMENT GRANTING CENTRAL POWER AND LIGHT COMPANY A UTILITY
EASEMENT FOR THE RELOCATION OF UTILITY TRANSMISSION LINES
ONTO 0. N. STEVENS WATER PLANT PROPERTY AT UP RIVER ROAD.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI:
SECTION 1. That the City Manager is hereby authorized to
execute an easement and right of way agreement granting Central Power
and Light Company a utility easement for the relocation of utility
transmission lines onto 0. N. Stevens Water Plant property at Up River
Road, as shown by plat as recorded in Volume 53, Pages 118-200, Map
Records, Nueces County, Texas, all as more fully described in the
Easement and Right of Way agreement attached hereto as Exhibit A.

KNOW ALL MEN BY THESE PRESENTS:
That the City of Corpus Christi, Texas, a home rule city and municipal corporation
existing under and by virtue of the laws of the State of Texas of the County of
Nueces, State of Texas, hereinafter called
in consideration of ten dollars
'Grantor", whether one or morefor and
(S. 10.00 ) Dollars. to Grantor in hand paid by Central Power and Light Company, P. 0. Box 2121,
Corpus Christi Texas 78403. a Texas corporation, "Grantee', the receipt and sufficiency of which is hereby
acknowledged arid confessed. has GRANTED, 5010, and CONVEYED, and by these presents does GRANT, SELL,
and CONVEY unto Grantee. its successors and assigns, an easement and right of way for electric transmission
lines. consisting of poles or towers rnade of wood. metal,other materials, wires, circuits, static wires, com-
municatlons circuits crossarms. insulators guys and all necessary or desirable appurtenances, over, across.
and upon the following described lands located in Nueces County, Texas, to wit.
Being two parcels of land containing 1.083 acres and 1.814 acres respectively out
of a 176.85 acre tract of land in the name of the City of Corpus Christi, Texas,
known as the 0.N. Stevens Treatment Plant as shown on map or plat as recorded in
Vol. 53, pages 118-120, Map Records, Nueces County, Texas.
The right of way being more particularly described by metes and bounds in attached
Exhibits "A" and "B".
Together with the right of ingress and egress over. across, and upon said land and Grantor's adjacent land
for the purpose of constructing, operating. reconstructing on poles or metal towers, enlarging, inspecting,
patrolling. repairing. maintaining, and removing said lines, circuits, poles, metal towers, wires, and appurte-
nances, the right to relocate along the satne general direction of said lines; and the right to remove from said
lands all trees and parts thereof. or other obstructions, which endanger or may interfere with the safety or
efficiency of sold Tines or appurtenances.
Grantor and Grantors s signs, agents. licensees, heirs and legal representatives, shall not
have the right to cause or permit ooriy obstruction except fences to be placed or constructed within said ease-
ment area without the express written consent of Grantee.
In addition to the consideration hereinobove provided, Grantee shall pay Grantor for all damage to Gran-
tor's growing cropsfurrows and fences done in connection with constructing. inspecting, maintaining, repair-
ing. reconstructing and removing said Tines on said land.
TO HAVE AND 10 HOLD the above described easement and rights unto the Grantee, Its successors and
assignsuntil all of said lines shall be abandoned and removed. Grantor binds himself, his heirs. assigns. and
legal representatives to warrant and forever defend all and singular the above described easement and rights
unto the said Grantee. Its successors and assigns, against every person whomsoever lawfully claiming or to
claim the same or ony part thereof.
