HomeMy WebLinkAbout020815 ORD - 10/31/1989ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF NUECES COUNTY, TEXAS, BY CHANGING THE ZONING MAP IN REFERENCE TO 4.340 ACRES OUT OF SECTION D, LOT 8, PAISLEY SUBDIVISION OF THE HOFFMAN TRACT FROM "I-2" LIGHT INDUSTRIAL DISTRICT TO "B-4" GENERAL BUSINESS DISTRICT; AND DECLARING AN EMERGENCY WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Nueces County, Texas, for amendment to the zoning map of the City of Corpus Christi. WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Tuesday, October 31, 1989, during a Council meeting of the City Council in the Council Chambers at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That the zoning on 4.340 acres out of Section D, Lot 8, Paisley Subdivision of the Hoffman Tract, in the City of Corpus Christi, Nueces County, Texas, and more fully described by metes and bounds attached hereto as Exhibit A, be changed from "I-2" Light Industrial District to "B-4" General Business District. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August 1973, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Councilmembers, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the ORD-RES\89036 2(l8t3 MICROFILMED aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at three regular meetings so that this ordinance is passed and shall take effect,.upon first reading ap- an emergency measure this the day of ! ; ! , 19 ATTEST: L City Secretary MAYOR CITY OF CORPUS CHRISTI APPROVED y�A DAY OF c , 19 HAL GEORGE, CITY ATTORNEY By, Ltt,i Assistant City Atj£orney \ORD-RES\89036 METES AND BOUNDS FOR APPLICATION NO. 989-6 (NUECES COUNTY, TEXAS) A 4.34 acre tract, more or less, out of Lot 8, Section D, Paisley Subdivision of the Hoffman Tract, as shown on Plat of Record in the Nueces County Plat Records, Nueces County, Texas, and more particularly described by metes and bounds as follows: BEGINNING at a point on the southeast right-of-way line of present 60.00 feet wide Dillon Lane, the southwest corner of Lot D-4, Hamlett-Rychetsky Tract, as shown on Plat of Record in Volume 21, Page 31, Nueces County Plat Records, Nueces County, Texas, for the north corner of this tract; THENCE South 61° 41' East, along said southwest boundary line of Lot D-4, Hamlett-Rychetsky Tract, a distance of 400.00 feet, more or less, to the northwest corner of Lot 4, Ayers Inuustrial Sites Subdivision, as shown on Plat of Record in Volume 34, Page 1, Nueces County Plat Records, Nueces County, Texas, for the east corner of the tract; THENCE South 28° 20' West along said northwest boundary line of Lot 4 and its southwesterly extension, a distance of 472.70 feet, more or less, to a point on the northeast right-of-way line of present 80.00 feet wide Gollihar Road, for the south corner of the tract; THENCE North 61° 40' along said present northeast right-of-way line of 80.00 feet wide Gollihar Road, a distance of 390.00 feet, more or less, to the point of beginning of a curve to the right, whose DELTA = 90° 00' 00', R = 10.00', T = 10.00 and L = 15.71'; THENCE along said curve to the right an arc distance of 15.71 feet, more or less, to its point of tangency on the southeast right-of-way line of afore- mentioned 60.00 feet wide Dillon Lane; THENCE North 28° 20' East along said southeast right-of-way line of 60.00 foot wide Dillon Lane, a distance of 462.7 feet, more or less, to the POINT OF BEGINNING.
