AUTHORIZING LEGAL COUNSEL AND INTERVENTION IN LITIGATION
FILED BY THE GUADALUPE-BLANCO RIVER AUTHORITY SEEKING
ADJUDICATION OF RIGHTS TO WATER IN THE EDWARDS AQUIFER.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS:
SECTION 1. That the City Manager be authorized to employ
legal counsel and that counsel be authorized to file an intervention
on behalf of the City of Corpus Christi in cooperation with the Nueces
River Authority and thereby make it a party to a suit in which the
Guadalupe -Blanco River Authority is plaintiff and styled No. 89-0381,
In Re: The Adjudication of Rights to Water in The Edwards Aquifer, in
the District Court of Hays County, Texas, 22d Judicial District, as
such counsel determines is a reasonable timely manner.
SECTION 2. That the City Manager and such legal counsel be
authorized to take in the above case all actions necessary to protect
water rights in the Nueces Basin and Coastal Bend, and in any
litigation that may be filed or instituted by the Guadalupe -Blanco
River Authority involving alleged violations under the Endangered
Species Act, including but not limited to filing such pleadings and
taking such actions as are proper in such cause or causes in
opposition to any position or allegation that the Edwards Aquifer is
an underground stream and a tributary of the Guadalupe River and that
the upper basin watercourses are tributaries of the Edwards Aquifer.
SECTION 3. That the City Manager and such legal counsel be
authorized to engage in any negotiations concerning possible
settlement of the above-mentioned cases and issues.
