HomeMy WebLinkAbout021060 ORD - 01/02/1991AN ORDINANCE CLOSING AND ABANDONING A BLANKET EASEMENT FOR PIPELINE RIGHT-OF-WAY DATED FEBRUARY 10, 1941, FROM MRS. J. R. WILKEY TO HOUSTON NATURAL GAS CORPORATION, WHICH WAS CONVEYED TO THE CITY OF CORPUS CHRISTI IN THE CONVEYANCE AND BILL OF SALE DATED DECEMBER 28, 1962, INSOFAR AS IT AFFECTS LOT E, SAMMONS SUBDIVISION; SUBJECT TO THE PROVISIONS LISTED BELOW; AND DECLARING AN EMERGENCY. WHEREAS, there exists a blanket easement for pipeline right- of-way dated February 10, 1941, (File No. 162149, Vol. 270, pg. 55, Deed Records, Nueces County, Texas) from Mrs. J. R. Wilkey to Houston Natural Gas Corporation which was conveyed to the City of Corpus Christi in the Conveyance and Bill of Sale dated December 28, 1962, and recorded in Vol. 985, Page 507, Deed Records, Nueces County, Texas, which affects Lot 16, Section 13, Flour Bluff and Encinal Farm and Garden Tracts, of which Lot E, Sammons Subdivision is a part; WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said easement, insofar as it affects Lot E, Sammons Subdivision, subject to the provisions listed below; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI: SECTION 1. That there is hereby abandoned a blanket easement for pipeline right-of-way dated February 10, 1941, (File No. 162149, Vol. 270, pg. 55, Deed Records, Nueces County, Texas) from Mrs. J. R. Wilkey to Houston Natural Gas Corporation which was conveyed to the City of Corpus Christi in the Conveyance and Bill of Sale dated December 28, 1962, and recorded in Vol. 985, Page 507, only insofar as it affects Lot E, Sammons Subdivision, as shown on Exhibit A, a part of Lot 16, Section 13, Flour Bluff and Encinal Farm and Garden Tracts, subject to the applicant paying the $100 application fee, and that a waiver of the replatting requirement is hereby granted. The City Manager is hereby authorized to execute all documents necessary to release said easement as provided herein. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose.
