AMENDING THE ZONING ORDINANCE UPON APPLICATION OF AQUA
PARK, INC. BY GRANTING A SPECIAL COUNCIL PERMIT FOR AN
AMUSEMENT PARK USE SUBJECT TO THE SITE PLAN AND SEVEN
CONDITIONS ON LOTS 3A, 5A, AND 6A, BLOCK 54, BROOKLYN
SUBDIVISION, LOCATED BETWEEN SEAGULL BOULEVARD AND U. S.
HIGHWAY 181 AND BETWEEN BRIDGEPORT AVENUE AND ELM
STREET; AND DECLARING AN EMERGENCY.
WHEREAS, the Planning Commission has forwarded to the City Council its
reports and recommendations concerning the application of Aqua Park, Inc. for amendment to
the zoning map of the City of Corpus Christi.
WHEREAS, public hearing was held at which hearing all persons wishing to
appear and be heard were heard to consider the same before the City Council of the City of
Corpus Christi, in accordance with proper notice to the public, said public hearing having been
held on Tuesday, January 8, 1991, during a meeting of the City Council in the Council
Chambers at City Hall in the City of Corpus Christi; and
WHEREAS, by motion duly made, seconded and carried, it was decided by the
City Council that to approve the hereinafter set forth amendment would best serve public
health, necessity and convenience and the general welfare of the City of Corpus Christi and its
citizens:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF CORPUS CHRISTI, TEXAS:
SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is
amended by making the change hereinafter set out.
SECTION 2. That a Special Council Permit be granted on Lots 3A, 5A, and 6A,
Block 54, Brooklyn Subdivision, situated in the City of Corpus Christi, Nueces County, Texas,
located between Seagull Boulevard and U. S. Highway 181 and between Bridgeport Avenue and
Elm Street, for an amusement park use subject to the site plan, a copy of which is attached
hereto and made a part hereof, marked Exhibit A, subject to the following conditions and
subject to all other considerations of "B-4" General Business District.
1. Use. The only uses authorized by this Special Permit other than the basic "B-4" District
uses, is an amusement park/carnival. That portion of the site located on the southem
end between Surfside and Seagull Boulevards is reserved for parking as shown on the
attached site plan.

2. Height. No structure exceeding 35 feet in height is permitted within 75 feet of the
property line fronting Seagull Boulevard and Elm Street.
3. Parking. A minimum of 316 parking spaces must be provided. Permanent "B-4" District
uses on-site may share up to 150 parking spaces beyond which normal parking
requirements must be met.
4. Landscaping: A minimum of 50 percent of the area between the right-of-way line and
the required masonry wall, as shown on the site plan, must be landscaped.
5. Screening: Screening walls are required:
a. 12 foot masonry wall along the south property line between Surfside and Seagull
Boulevards;
b. 12 foot masonry wall along and set back 10 feet from the Seagull Boulevard and
Elm Street right-of-way line;
c. 6 foot high screening fence on the property line along the West Surfside
Boulevard frontage; and
d. Openings are allowed as per the attached site plan.
6. Lighting. All site and parking lot lighting must be directed downward and away from
residential properties and public right-of-way so as to prevent glare.
7. Hours of Operation: The carnival may not open before 9:00 a.m. Monday through
Saturday and 12 noon Sunday and must close all facilities by 12:00 midnight.
In the event the Board of Adjustment grants any special exception or variance to
the Zoning Ordinance, applicable to the Special Permit herein granted, other than the one
specified in this Special Permit, said Special Permit shall be void and of no force and effect
whatsoever.
SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be
and the same is hereby amended as herein ordained.
SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi,
Texas, approved on the 27th day of August, 1973, as amended from time to time, except as
herein changed, shall remain in full force and effect.
SECTION 5. That all ordinances or parts of ordinances in conflict herewith are
hereby expressly repealed.

SECTION 6. That upon written request of the Mayor or five Council members,
copy attached, to find and declare an emergency due to the need for efficient administration of
City affairs by granting the aforesaid zoning change, such finding of an emergency is made and
declared requiring suspension of the Charter rule as to consideration and voting upon
ordinances at three regular meetings so that this inane is pass and shall take effect upon

For the reasons set forth in the emergency clause of the foregoing
ordinance an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances at three regular
meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance finally on the date it is introduced, or at
the present meeting of the City Council.
