CANVASSING RETURNS AND DECLARING THE RESULTS OF THE
SPECIAL ELECTION HELD ON JANUARY 19, 1991, IN THE CITY OF
CORPUS CHRISTI TO CONSIDER AMENDMENTS TO THE CHARTER
OF THE CITY OF CORPUS CHRISTI; AND DECLARING AN
EMERGENCY.
WHEREAS, the City Council of the City of Corpus Christi ordered and called
a Special Election to consider amendments to the Charter of the City of Corpus Christi; and
WHEREAS, notice of said election was given as required by law and as
directed in said ordinance, as is shown by affidavit properly filed in the office of the City
Secretary; and
WHEREAS, said election was duly held on the 19th day of January 1991 in
conformity with the election laws of the State of Texas, and the results of said election have
been certified and returned by the judges and clerks thereof; and
WHEREAS, this Council has today canvassed the returns of said election held
on the 19th day of January 1991; and
WHEREAS, the Council finds that the said election was in all respects lawfully
held and that the City Secretary's tally and certification of results to the Council are correct:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF CORPUS CHRISTI, TEXAS:
SECTION 1. That the tally of votes cast in the special election held on the
19th day of January 1991, made and certified by the City Secretary of the City of Corpus
Christi, a copy of which is attached hereto and made a part hereof, be and the same is
hereby adopted as the official tally of the votes cast at said election and that said tally be
filed and recorded in the official records of the City of Corpus Christi as the official canvass
of said election.
SECTION 2. That the results of such canvass are declared to be:
Charter Amendment 1
18,286 For Amending Article IX, Section 10, of the
Charter of the City of Corpus Christi to
provide for a new subsection (a) to read as

9,839 Against follows:
(a) The rate for each utility service
operated by the City shall not be increased
in any fiscal year by more than six percent
(6%) over the rate charged the preceding
year; provided, however, in the event of an
emergency declared by the council with all
members voting "aye" on the increase,
then a higher rate may be adopted on a
temporary basis for the next fiscal year.
Effective on voter approval.
Charter Amendment 2
10,759 For Amending the Charter of the City of
Corpus Christi to provide for a Preamble

We hold these truths to be self-evident,
that all members of the human family,
regardless of age, development, physical or
mental condition, race, or national origin,
are created equal and are endowed by
their Creator with the inalienable rights to
Life, Liberty, and the pursuit of
Happiness. Human life begins at
conception and continues until natural
death.
Charter Amendment 3
11,664 For Amending Article IX, Section 10, of the
Charter of the City of Corpus Christi by
15,340 Against adding a new subsection (b) as follows:
(b) The rate for each utility service
operated by the city shall not be increased

year except for debt service, increases
mandated by another government entity,
and pass-through costs. Provided,
however, in the event of an emergency
declared by the council with all members
voting "aye" on the increase, then a higher
rate may be adopted on a temporary basis
for the next fiscal year. Effective on voter
approval.
Charter Amendment 4
21,107 For Amending Article II, Section 1, of the
Charter of the City of Corpus Christi,
providing for elections on a Saturday in
April or the next available uniform
4,625 Against election date selected by the City Council
at least six months prior to the regular
election.
Charter Amendment 5
21,293 For Amending Article VI, Section 1, of the
Charter of the City of Corpus Christi,
clarifying the six-year length of service
5,072 Against limitation on citizens appointed to city
boards and commission.
Charter Amendment 6
21,795 For Amending Article X, Section 2, of the
Charter of the City of Corpus Christi
authorizing city procurement through
4,073 Against competitive bids and proposals as
authorized by state law.

Charter Amendment 7
19,941 For An Amendment to Article VIII, Section 2,
of the Charter of the City of Corpus
Christi, conforming the provisions on the
5,648 Against issue of City bonds to the requirements set
by state law.
SECTION 3. That it is hereby ordered and declared that Charter Amendments
No. 1, No. 4, No. 5, No. 6, and No. 7 shall take effect immediately and shall be entered in the
records of the City of Corpus Christi as amendments to the Charter of the City of Corpus Christi.
SECTION 4. The necessity of making an official canvass of votes and declaring the
results thereof immediately in order to meet the requirements of state law and the City Charter
creates a public emergency and an imperative public necessity requiring the suspension of the
Charter rule that no ordinance shall be passed finally on the date of its introduction but that such
ordinance shall be read at three several meetings of the City Council, and the Mayor, having
declared that such emergency and necessity exist, having requested the suspension of the Charter
rule and that this ordinance be passed finally on the date of its introduction and take effect and be
in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this

For the reasons set forth in the emergency clause of the foregoing
ordinance an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances at three regular
meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance finally on the date it is introduced, or at
the present meeting of the City Council.
