ORDERING A GENERAL ELECTION TO BE HELD ON APRIL 6, 1991,
IN THE CITY OF CORPUS CHRISTI FOR THE ELECTION OF MAYOR
AND EIGHT COUNCIL MEMBERS; PROVIDING FOR A
REFERENDUM ON UTILITY RATES FOR WATER, GAS, AND
WASTEWATER; PROVIDING PROCEDURES FOR HOLDING OF
SUCH ELECTION; PROVIDING FOR NOTICE OF ELECTION AND
PUBLICATION THEREOF; PROVIDING FOR ESTABLISHMENT OF
BRANCH ABSENTEE POLLING PLACES; DESIGNATING POLLING
PLACE LOCATIONS; ENACTING PROVISIONS INCIDENT AND
RELATING TO THE SUBJECT AND PURPOSE OF THIS ORDINANCE;
AND DECLARING AN EMERGENCY.
WHEREAS, the City Charter provides for the holding of a regular City
election for Mayor and Council members in the City of Corpus Christi, on the first Saturday
in April in odd -numbered years, the same being April 6, 1991; and
WHEREAS, it is provided in Section 3.004 of the Texas Election Code that
the governing body shall order elections pertaining to municipal affairs, give notice and
appoint election officers to hold the election;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF CORPUS CHRISTI, TEXAS:
SECTION 1. That a regular City election for the election of Mayor and eight
Council members shall be held in the City of Corpus Christi, Texas, on April 6, 1991.
SECTION 2. That at said election herein ordered all the qualified voters of
the City of Corpus Christi shall be permitted to vote.
SECTION 3. That the names of candidates for the office of Mayor and the
names of candidates for the office of the City Council members shall be placed on said
ballot in the manner and form prescribed by law.
SECTION 4. That an election is hereby ordered to be held on April 6, 1991,
in the City of Corpus Christi for the consideration of the following question:
Should Ordinance No. 21001, adopted by the City Council on October 9, 1990,
"PROVIDING FOR AMENDMENTS TO THE CODE OF ORDINANCES
THAT WOULD ALLOW FOR INCREASES IN UTILITY SERVICE
RATES WITHIN THE CITY OF CORPUS CHRISTI AS FOLLOWS:
SECTION 55-50 SCHEDULE FOR WATER RATES INCREASED BY
THREE PERCENT (3%), SECTION 55-61 SCHEDULE FOR GAS RATES
INCREASED BY TWO PERCENT (2%), AND SECTION 55-100
SCHEDULE FOR SEWER RATES (EXCEPT FOR DRIED SLUDGE)
INCREASED BY NINE AND ONE-HALF PERCENT (9.5%)," be repealed?

The official ballot for said election shall be prepared in accordance with the Texas Election
Code so as to permit the electors to vote "YES" OR "NO" as to the aforesaid Question,
which shall be set forth in substantially the following form:

UTILITY RATE PROPOSITION
Shall Ordinance No. 21001 providing for increases in water
rates by 3%, gas rates by 2%, and wastewater rates by 9.5% be
repealed?
SECTION 5. That voting machines shall be employed at the election herein
ordered in accordance with the Texas Election Code and said election shall be held at the
polling places in the regularly prescribed precincts of the City of Corpus Christi, such voting
precincts and polling places being set forth on Attachment A hereto, incorporated by
reference and made part of this ordinance. Said election shall be held in accordance with
the election laws of the State of Texas. The polls shall be open from 7:00 a.m. to 7:00 p.m.
on the day of the election.
SECTION 6. The City Secretary, Armando Chapa, whose office is situated
at the Office of the City Secretary, First Floor, City Hall, 1201 Leopard Street, Corpus
Christi, Texas, is hereby appointed as the authority and officer responsible for the conduct
of said election and is hereby authorized and directed to make all necessary arrangements
for the holding of said election in accordance with and subject to the laws of this State. The
City Secretary is hereby appointed the Absentee Voting Clerk for absentee voting. Absentee
voting shall be conducted at the absentee polling places as provided herein.
SECTION 7. Voting machines shall be used for the conduct of said election
on election day and paper ballots shall be used for conducting absentee voting. Absentee
voting in person shall be conducted from 8:00 a.m to 5:00 p.m., Monday through Friday,
beginning on March 18, 1991, and ending April 2, 1991, and on Saturday, March 30, 1991.
Absentee voting in person may be conducted at the main absentee polling place located in
the lobby of City Hall, the same being designated as the office of the City Secretary, 1201
Leopard, or at the temporary branch polling places hereby established as follows:

Each branch polling place and the main absentee polling place shall serve all election
precincts.
SECTION 8. The City Secretary is directed to post and publish such election
notices as are required by the Election Laws of the State of Texas.

SECTION 9. By approving and signing this ordinance, the Mayor officially
confirms as her action all matters recited in this ordinance which by law come within her
jurisdiction.
SECTION 10. If for any reason any section, paragraph, subdivision, clause,
phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final
judgment of a court of competent jurisdiction, it shall not affect any other section,
paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the
definite intent of this City Council that every section, paragraph, subdivision, clause, phrase,
word or provision hereof be given full force and effect for its purposes.
SECTION 11. The fact that it is necessary and essential that the governing
body of the City of Corpus Christi shall order elections pertaining to municipal affairs, that
the notice of such election should be promptly posted and published and that a regular City
election for the election of the Mayor and Council members in the City of Corpus Christi
shall be held on the first Saturday in April, 1991, and that the requirements of the Voting
Rights Act of 1965 may be timely met, and immediate action is necessary for the efficient
and effective administration of the City's affairs to comply with all applicable laws, creates
a public emergency and an imperative public necessity requiring the suspension of the
Charter rule that no ordinance shall be passed finally on the date of its introduction but that
such ordinance shall be read at three several meetings of the City Council, and the Mayor,
having declared that such emergency and necessity exist, having requested the suspension
of the Charter rule and that this ordinance be passed finally on the date of its introduction
and take effect and be in full force and effect from and after its passage, IT IS

For the reasons set forth in the emergency clause of the foregoing
ordinance an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances at three regular
meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance finally on the date it is introduced, or at
the present meeting of the City Council.
