HomeMy WebLinkAbout021077 ORD - 02/12/1991AN ORDINANCE CLOSING AND ABANDONING HUISACHE STREET FROM BUDDY LAWRENCE DRIVE TO THE INTERSTATE HIGHWAY 37 RIGHT-OF- WAY; SUBJECT TO THE PROVISIONS LISTED BELOW. WHEREAS, notice of the time and place for holding a hearing concerning the closing of Huisache Street from Buddy Lawrence Drive to the Interstate Highway 37 right-of- way, was given by publication and mailed to the last known addresses of the owners of property abutting the public way and within 450 feet of the area proposed to be closed, and thereafter, pursuant to said notice, public hearing was held at a meeting of the City Council of the City of Corpus Christi on January 29, 1991, in accordance with the provisions of the City Charter; and WHEREAS, it was determined by the City Council after such hearing that the aforesaid portion of right-of-way, proposed to be closed, is not needed now, nor will it be within the foreseeable future needed as public right-of-way, and that the same should revert to the abutting property owners, subject to certain specified conditions: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI: SECTION 1: That there is hereby closed and abandoned Huisache Street from Buddy Lawrence Drive to the Interstate Highway 37 right-of-way, subject to the applicant replatting said property within 180 days of passage of this ordinance, and complying with the following conditions: 1. Adjustment of an existing 6 -inch sanitary sewer line as required by the City Engineer. 2. Design and construction of structure to protect the integrity of a 6' x 4' storm sewer box to sustain additional loads on the system acceptable to the City Engineer. 3. Dedication of a utility easement with minimum width of 15 feet to encompass the existing storm sewer. 4. Construction of water facilities and dedication of utility easements to replace those within the abandoned right-of-way as required by the Water Superintendent and City Engineer. 5. Construction plans to be submitted for review and approval. Construction to be inspected and approved by the City. 6. Payment of costs incurred as a result of construction shall be at the applicant's expense. 7. Payment of relocation costs for CP&L's distribution facilities on Huisache or dedication of a ten foot wide utility easement. 8. Payment of relocation costs for Southwestern Bell Telephone Company's aerial cable facilities or dedication of a ten foot wide utility easement. 9. Payment of relocation cost for TCI Cablevision's equipment or dedication of utility easement. 10. Payment of fair market value. Fair market value, appraised at $25,900 or $0.80 per square foot, will be deposited into the Street Trust Fund for future street improvements and/or acquisition.
