PARTIALLY REPEALING ORDINANCE NO. 21001; AMENDING
SECTIONS 55-50 AND 55-100 OF THE CITY CODE OF ORDINANCES
REGARDING WATER, AND WASTEWATER RATES AND MAXIMUM
QUANTITIES TO WHICH WASTEWATER RATES ARE APPLICABLE;
AND DECLARING AN EMERGENCY.
WHEREAS, on October 9, 1990, the City Council adopted Ordinance No.
21001 increasing water, gas, and wastewater rates; and
WHEREAS, the City Council has determined that Ordinance No. 21001
should be partially repealed, and that Sections 55-50 and 55-100 of the City Code should be
amended;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF CORPUS CHRISTI, TEXAS:
SECTION 1. That Ordinance No. 21001 is hereby repealed to the extent of
the amendments provided herein.
SECTION 2. That City Code, Chapter 55, Utilities, Article III, Water Rates
and Charges, Section 55-50, Schedule, is hereby amended to hereafter provide as follows:

SECTION 3. That the City Code, Chapter 55, Utilities, Article VII, Sewer
Rates. Section 55-100, Schedule, is hereby amended to hereafter provide as follows:

WASTEWATER SERVICE CUSTOMERS WITH WASTEWATER
CHARACTERISTICS OF 250 PARTS PER MILLION OR LESS OF
BIOCHEMICAL OXYGEN DEMAND, AND 250 PARTS PER MILLION
OR LESS OF SUSPENDED SOLIDS.

other sewer users, will be computed as dollars per one thousand (1,000) gallons of water
used as follows:

SECTION 4. That the increases set forth in Ordinance No. 21001 for gas
rates and commercial wastewater rates shall continue unchanged.
SECTION 5. The rates and charges established in this ordinance shall be
applied against all service provided beginning with Cycle 15 billings on or about March 21,
1991, for February service, and the provisions of this ordinance shall not be effective until
such time.
SECTION 6. If for any reason any section, paragraph, subdivision, clause,
phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final
judgment of a court of competent jurisdiction, it shall not affect any other section,
paragraph, subdivision, clause, phrase, word or provision of this ordinance for it is the
definite intent of this City Council that every section, paragraph, subdivision, clause, phrase,
word or provision hereof be given full force and effect for its purpose.
SECTION 7. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for the efficient
and effective administration of City affairs, such finding of an emergency is made and
declared requiring suspension of the Charter rule as to consideration and voting upon
ordinances at three regular meetings so that this ordinance is filially passed first

For the reasons set forth in the emergency clause of the foregoing
ordinance an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances at three regular
meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance finally on the date it is introduced, or at
the present meeting of the City Council.
