HomeMy WebLinkAbout021080 ORD - 02/12/1991AN ORDINANCE AMENDING ORDINANCE NO. 021073 ORDERING AN ELECTION ON APRIL 6, 1991, TO EXCLUDE A REFERENDUM ON UTILITY RATES FOR WAIUt, GAS, AND WASIEWAIU(, AND DECLARING AN EMERGENCY. WHEREAS, on January 29, 1991, the City Council of the City of Corpus Christi, Texas, adopted Ordinance No. 021073, calling an election for April 6, 1991; and WHEREAS, said ordinance should be amended; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Section 4 of said Ordinance No. 021073 (ordering an election to be held on the question of whether Ordinance No. 21001 should be repealed) is hereby repealed, and said matter shall not appear on the April 6, 1991, ballot. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purposes. SECTION 3. The fact that it is necessary and essential that the governing body of the City of Corpus Christi shall order elections pertaining to municipal affairs, that the notice of such election should be timely posted and published, and that the requirements of the Voting Rights Act of 1965 may be timely met, and immediate action is necessary for the efficient and effective administration of the City's affairs to comply with all applicable laws, creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance shall be passed finally on the date of its introduction but that such ordinance shall be read at three several meetings of the City Council, and the Mayor, having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from anc,after its passage, IT IS ACCO --- ------ RDINGLY SO ORDAINED, this the I �� day of �l�_IJ LI0}1t_f A1'1EST: AmetS City Secretary ORD3:91028 , 1991.
