AUTHORIZING THE EXECUTION OF A CONTRACT
WITH H. PLATT THOMPSON ENGINEERING, INC.,
PROVIDING FOR A FIRST -ORDER HORIZONTAL
CONTROL NETWORK UTILIZING THE GLOBAL
POSITIONING SYSTEM (GPS); APPROPRIATING
$184,000; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS:
SECTION 1. That the City Manager is hereby authorized to execute a
contract with H. Platt Thompson Engineering, Inc., providing for a first -order horizontal
control network utilizing the Global Positioning System (GPS), all as more fully set forth in
the contract, a substantial copy of which is attached hereto and made a part hereof, marked
Exhibit A.
SECTION 2. That there is hereby appropriated $184,000 from the No. 220
Street Bond Fund Construction Interest of which $114,916 is for the contract award and
$69,084 is for hardware, software, and training support applicable to Project No. 220-601-
602.25, GIS Survey Control Network.
SECTION 3. That upon written request of the Mayor or five
Councilmembers, copy attached, to find and declare an emergency due to the need of
executing the above-mentioned contract at the earliest practicable date, such finding of an
emergency is made and declared requiring suspension of the Charter rule as to consideration
and voting upon ordinances at three regular meetings so that this ordinance is passed and
sh take effect upon first yeading as an emergency measure this the ',+h day of

CONTRACT FOR GLOBAL POSITIONING SYSTEM SERVICES

The City of Corpus Christi, Texas, hereinafter called "City" and H. Platt
Thompson Engineering Company, Inc., hereinafter called "Surveyor", agree as
follows:
I, SERVICES TO BE PERFORMED
The Surveyor hereby agrees, at his own expense, to provide all GPS
services necessary to properly develop a horizontal and vertical control
network encompassing approximately 125 square miles of the City of Corpus
Christi meeting accuracy levels stipulated in the Scope of Services section of
this agreement.
II. SCOPE OF SERVICES
A. Scope of Work
1. The Surveyor shall physically construct and establish
approximately 14 Type "B" monuments (Exhibit 'A') in existing
sidewalks, curbs, headwalls, inlets, or other suitable
locations, as specified by the City, by drilling a hole and
epoxy grouting -in a survey monument disk provided by the City.
2. The Surveyor shall physically construct and establish
approximately 71 Type "A" monuments (Exhibit '8') at or near
locations specified by the City.
3. The Surveyor shall prepare a sketch in the field of each
monument location, utilizing the City's base drawings giving
general and specific distance cies to existing landmarks to aid
in the future recovery of the monument.
4. The Surveyor shall, as specified by the City establish
horizontal and vertical positions on approximately 85 proposed
monuments and occupy up to five existing monuments with known
positions for a total of 90 individual sites to be occupied.
5. The Surveyor shall provide a proposed work schedule for City
Approval at the beginning of the project, weekly progress
reports during the field portion of the work, including sample
data, and weekly reports during the calculation phase of the
project.
6. The Surveyor shall have a minimum of six (6), two (2) person
field crews equipped with Trimble 4000 SST or ST (or
compatible) GPS receiver units, each session and a
communication package to be utilized throughout this project.

7. The Surveyor shall schedule all work in accordance with the
current satellite constellation to insure a minimum visibility
of four (4) satellites, throughout each session. Each session
shall consist of a minimum of fifty (50) minutes of satellite
observation time. The work schedule shall provide for a
minimum of 2, with an average of 2.5, independent occupations
on all monument sites, on a network wide basis.
8. The Surveyor shall employ the static data collection method
throughout this project. The data obtained by each receiver
shall be down -loaded into a suitable computer and configured
into separate data files after each day's use to avoid any
possible disorder or loss of data, and for ease of
accessibility at time when data is analyzed.
9. The Surveyor shall verify the integrity of the raw data and
formulate, adopt, and execute a processing strategy. Through
this process, numerous independent and redundant single
baselines shall be calculated for the various points of the
project.
10. The Surveyor shall utilize Trimble's TRIMNET Network Adjustment
Software (or equal) and employ the candidate solution vectors,
to construct a network. The Surveyor shall utilize the WGS-84
geographic global coordinate system (NAD 83) to obtain a
minimally -constrained adjustment, and through an iterative
process, the network shall be further refined until a
satisfactory adjusted network is established.
11. The Surveyor shall constrain the network by choosing Existing
National Geodetic Survey (NGS) monuments within and near the
project and holding their published coordinates as fixed
network coordinates. Once the "hold" monuments are chosen, a
fully -constrained adjustment of the network shall be developed
for the NAD 83 datum based on the Texas State Plane Coordinate
System, South Zone.
12. The Surveyor shall prepare and submit the National Geodetic
Survey Submission Data according to "Input Format and
Specifications of the National Geodetic Survey Data Base -
Volume 1, Horizontal Control Data, Rockville, MD, January 1989"
(blue book) for five of the points as directed by the City
Manager or his Designee (City Manager), for inclusion in the
national system.
13. The Surveyor shall establish a fully constrained and adjusted
network which shall have a minimum precision ratio of closure
of 1:100,000 for the horizontal survey data generated, using
the NAD 83 Datum. The vertical components of the network shall
be established by including vertical data (NGS or others),
provided by the City in the data collection and the network, to
a precision level of plus or minus three tenths of a foot
(0.3').

14. The Surveyor shall be responsible for practicing safety
measures throughout the duration of this project, including
utilization of traffic cones, warning signage, and safety
lights for vehicles if deemed necessary.
15. The Surveyor shall provide continuous radio or telephone
communication between each receiver unit so that any problems
encountered may be dealt with immediately and to optimize the
session schedule.
16. The Surveyor shall require the crew chief for each GPS receiver
unit, per session, to maintain a log book throughout the
duration of this project. The log book shall contain the
serial number of each GPS receiver unit used, the station
designation occupied by each unit, the time it was turned on
and off, and the height of the unit above ground along with any
pertinent information regarding the weather conditions at and
the physical environment around each observed station, and the
name of the crew chief in charge.
17. The Surveyor shall provide the necessary project management and
coordination of the services to perform the work, as set out
herein.
18. The Surveyor shall be responsible for providing material,
transportation and the construction of an observation tower for
utilization on one to four points as directed by City Surveyor
or his Designee (City Surveyor).
19. The time of completion for the base project (Phase I and II)
shall be 30 calendar days and 30 calendar days for the required
calculations, and Report (Phase II1). The City Manager may
allow additional working days upon written request from the
Surveyor. •
20. The City Surveyor, shall serve as initial contact with the City
for all matters related to this contract.
21. All weekly progress reports, weekly reports and other work
generated by this project shall be submitted for approval by
the City Surveyor at the Surveyor's expense to City of Corpus
Christi, Engineering Services, City Hall, P. 0. Box 9277, 1201
Leopard, Corpus Christi, TX 78469-9277.
Materials to be Furnished to Surveyor by City
1. A map showing general location of the proposed monument
stations for which GPS data shall be obtained.
2. Listing of proposed GPS monument stations.
3. Recovery sketches of proposed GPS monument stations.

4. Listing of existing monuments with known horizontal positions
to be us_d for control of the horizontal network.
5. Listing of existing vertical monuments with known and proven
elevations to be used for control of the vertical network.
6. Materials for constructing proposed monuments (except concrete
and sand).
Materials to be Furnished to City by Surveyor
1. Listing of each monument station observed together with the
correct station designation, latitude and longitude values,
along with the scale factors and their coordinate values based
upon NAD 1983, and the vertical position (elevation).
2. All final survey data in hard -copy form and in electronic
format on 3.5" diskette and all raw data, pre-processing,
processing, and network adjustment information on 32 track
tape furnished by the City. The City shall have ownership of
all data and documents generated by this contract.
3. Reproducible computer plot showing overall monument scheme with
the station designations.
4. Project Report, generally conforming to GPS Project Management
Standards as established by the American Congress on Surveying
and Mapping (Ref. - Planning and Executing GPS Survey Course
1.02, Continuing Education Courses).
5. All equipment, labor, concrete, and sand required to construct
all monuments.
6. All revisions or updates of data and documents as a result of
re -processing and corrections due to errors or omissions by the
Surveyor.
B. Required Coordination Efforts
In addition to the routine coordination of this project with
designated representative of the Director of Engineering Services, direct
coordination efforts shall be made with the City Surveyor to incorporate
specific operational requirements. The Surveyor will be required to
coordinate with the GIS/CADD System Coordinator to insure compatibility of
data with the City system.
C. Order of Services
Surveyor agrees to begin work immediately after written
authorization from the City to complete the GPS project within 60 calendar
days.

111. FEE
A. Fee for basic Services
The City will pay the Surveyor a fixed fee of $114,916.00 for
performing all basic survey services defined herein for the project. This fee
will be full and total compensation for all services outlined in this
contract. Surveyor shall pay all independent sub -contractors out of this fee.
The fee shall be payable in phases per the schedule defined in Section IV with
the balance of $18,616.00 to be paid upon approval and final acceptance by the
City Manager.
IV. TERMINATION OF CONTRACT
The City may, at any time, with or without cause, terminate this
Contract upon seven days written notice to the Surveyor at the address of
record. In this event, the Surveyor shall be compensated for his services on
all stages authorized as follows:
A. Upon completion of Phase I, consisting of site reconnaissance and
monument construction, subject to approval and acceptance, by the City
Manager, of said monument construction, the sum of $21,500, shall be due and
payable.
8. Upon completion of Phase II, but prior to Phase III, the sum of
$74,800, shall be due and payable. Phase II consists of field data collection
and pre-processing required for this contract. Phase III includes final
processing, network adjustment and final report.
C. If termination occurs after Phase III but prior to final completion
or acceptance by the City Manager, the fees of the Surveyor shall be computed
in accordance with the provisions of Section III of this contract to the date
of termination.
D. The foregoing shall not be construed to require the City to
compensate the Surveyor for any services not performed in a proper
professional manner suitable for use in the City's GIS System.
In the event that this contract is terminated, for whatever cause,
all documents (i.e. reports, plats, etc.) shall be turned over to the City
within ten (10) days of issuance of the written notice of termination to the
address of record. The City shall be entitled to ownership of all documents.
V. RENEGOTIATION
In the event that the scope of the Surveyor's services as outlined
herein for the improvement project is determined to be substantially different
from the description of services contained herein, the fees set forth in this
Contract shall be renegotiable only insofar as this Contract pertains to the
project or projects so determined to be substantially different. Fees for
projects determined to be substantially in accordance with descriptions
contained herein shall not be renegotiable.

VI. ASSIGNABILITY
The Surveyor shall not assign, transfer, or delegate any of his
obligations or duties in this Contract to any other person without the prior
written consent of the City Manager, except for routine duties delegated to
personnel of the Surveyor's staff. If the Surveyor is a partnership, in the
event of the termination of the partnership, this Contract shall inure to the
individual benefit of such partner or partners as the City Manager may
approve. No part of the Surveyor's fee may be assigned in advance of receipt
of payment by the Surveyor without the prior written consent of the City
Manager.
VII. SURVEYOR'S LIABILITY
A. Acceptance and approval of the report by the City shall not
constitute nor be deemed a release of the responsibility and liability of the
Surveyor, his employees, associated, agents and consultants, for the accuracy
and competence of his processing, network adjustment results, reports or other
documents of work, nor shall such approval be deemed to be an assumption of
such responsibility by the City for any defect in processing, network
adjustment or other documents prepared by the Surveyor, his employees,
subcontractors, agents and consultants.
B. It is contemplated that Surveyor will hire independent
subcontractors to perform certain parts of the project. Surveyor shall be
responsible for the quality of work performed by the Subcontractors. It any
such work is unacceptable to the City, then Surveyor shall redo the work so
that it is acceptable to the City at no charge to the City.
C. Subsequent to completion of contract, Surveyor shall make and
provide to the City, at Surveyor's cost, all revisions and/or corrections
necessary to resolve discrepancies, arising from Surveyor's actions, in any
and all information provided to the City by Surveyor for a period of time as
defined by state law.
VIII. RESPONSIBILITY FOR DAMAGE CLAIMS:
The Surveyor shall not commence work under this contract until he
has obtained all insurance required herein and such insurance has been
approved by the City. The Surveyor shall not allow any subcontractor(s) to
commence work until all similar insurance required of the subcontractor(s) has
been so obtained.
The Surveyor shall furnish Certificates of Insurance, with the City
named as an additional insured, to the City for approval within ten (10)
calendar days after the contract is awarded and the Surveyor has been
requested to execute the contract documents. These certificates and any
subsequent insurance certificates in connection with this particular contract
shall be delivered to the offices of the City Engineer. The Certificates of
Insurance shall state that thirty (30) days written notice will be given the
City before any policy covered thereby is changed or cancelled and shall show
the following minimum coverage in an insurance company acceptable to the City.

The City reserves the right to modify minimum limits based upon the nature and
scope of the work. Upon written request, the contractor will provide copies
of the policies to the Risk Manager.

In the event of accidents of any kind, the Surveyor shall furnish the
City with copies of all reports of such accidents at the same time that the
reports are forwarded to any other interested parties. It shall be the
Contractor's primary responsibility for immediately notifying the carriers of
any or all insurances under this contract in the event of a known loss or
claim presented to the Surveyor by the City or a third party.
Surveyor agrees to indemnify, save harmless and defend the City, its
agents, servants, and employees, and each of them against and hold it and them
harmless from any and all lawsuits, claims, demands, liabilities, losses and
expenses, including court costs and attorneys' fees, for or on account of any
injury to any person, or any death at any time resulting from such injury, or
any damage to any property, which may arise or which may be alleged to have
arisen out of or in connection with the work covered by this contract. The
foregoing indemnity shall apply except if such injury, death or damage is
caused directly by the sole negligence or other fault of the City, its agents,
servants, or employees or any other person indemnified hereunder.

IX. LOCAL PARTICIPATION POLICY
The City Council's stated policy is for City expenditures on
contracts for engineering services be of maximum benefit to the local economy.
The Surveyor hereby agrees that a minimum of 25% of the work described herein
will be performed in the City of Corpus Christi by the local labor force.
The Surveyor shall provide, upon request of the "City Manager", such
records indicating which services were rendered under this contract by
employees or agents of Surveyor which are not members of the local labor
force. Local labor force is defined as services rendered by individuals
residing and having their principalplace of employment within the Standard
Metropolitan Statistical Area of Corpus Christi, Nueces County Texas.
X. TECHNICAL ASSISTANCE AND CONSULTANTS
The City shall not pay the fees of expert or technical assistance
and consultants unless such employment, including the rate of compensation,
has prior written approval of the "City Manager".
XI. DISCLOSURE OF INTERESTS
Surveyor further agrees, in compliance with City of Corpus Christi
Ordinance No. 17112, to complete, as part of this Contract, the Disclosure of
Interests form attached hereto.
