AMENDING THE ZONING ORDINANCE UPON APPLICATION OF
IOAN CHERCIU BY GRANTING A SPECIAL COUNCIL PERMIT FOR
A GOLF DRIVING RANGE SUBJECT TO SITE PLAN AND EIGHT
CONDITIONS ON ALL OF LOTS 15 THROUGH 22 AND A PORTION
OF LOTS 23 AND 24, BLOCK 3, EDGEWATER TERRACE, AND A
PORTION OF LOTS 1, Z 12 AND 13, SECTION 17, FLOUR BLUFF AND
ENCINAL FARM AND GARDEN TRACTS, LOCATED ON THE SOUTH
SIDE OF DEL OSO ROAD ADJACENT TO THE CORPUS CHRISTI
OSO GOLF COURSE; AND DECLARING AN EMERGENCY.
WHEREAS, the Planning Commission has forwarded to the City Council its
reports and recommendations concerning the application of Ioan Cherciu for amendment
to the zoning map of the City of Corpus Christi, Texas;
WHEREAS, public hearing was held at which hearing all persons wishing to
appear and be heard were heard to consider the same before the City Council of the City
of Corpus Christi, in accordance with proper notice to the public, said public hearing having
been held on Tuesday, March 5, 1991, during a meeting of the City Council in the Council
Chambers at City Hall in the City of Corpus Christi; and
WHEREAS, by motion duly made, seconded and carried, it was decided by
the City Council that to approve the hereinafter set forth amendment would best serve
public health, necessity and convenience and the general welfare of the City of Corpus
Christi and its citizens:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF CORPUS CHRISTI, TEXAS:
SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas,
is amended by making the change hereinafter set out.
SECTION 2. That a Special Council Permit be granted on all of Lots 15
through 22 and a portion of Lots 23 and 24, Block 3, Edgewater Terrace, and a portion of
Lots 1, 2, 12 and 13, Section 17, Flour Bluff and Encinal Farm and Garden Tracts, as more
specifically described by the metes and bounds description attached hereto as Exhibit A,
located on the south side of Del Oso Road adjacent to the Corpus Christi Oso Golf Course,
situated in the City of Corpus Christi, Nueces County, Texas, for a golf driving range,
according to the site plan, a copy of which is attached hereto and made a part hereof,
marked Exhibit B, and subject to the following conditions:

1. Use. The only use authorized by this Special Permit other than the basic "A-1"
District uses is a golf driving range with an accessory club house.
2. Floor Area. The property is limited to one (1), 640 square foot club house and one
(1), 150 square foot storage building.
3. Tees. The maximum number of practice tees permitted on the property is 30.
4. Parking. The property must provide at all times a minimum of 33 parking spaces and
located as shown on the attached site plan.
5. Signs. The property may have one (1) wall -mounted sign not to exceed 20 square
feet. The sign may not be mounted on the south facade of the club house or storage
building.
6. Lighting. All lighting on the property must be directional lighting and directed away
from any single-family residence. The light standards may not exceed a height of 40
feet as measured from the adjoining ground level.
7. Hours of Operation. The hours of operation for the golf driving range and its
accessory uses are limited to the hours of 8:00 a.m. to 10:00 p.m.
8. Sound Systems. The use of outside speakers, microphones, or public address systems
on the property are prohibited.

In the event the Board of Adjustment grants any special exception or variance
to the Zoning Ordinance, applicable to the Special Permit herein granted, other than the
one specified in this Special Permit, said Special Permit shall be void and of no force and
effect whatsoever.
SECTION 3. That the official zoning map of the City of Corpus Christi,
Texas, be and the same is hereby amended as herein ordained.
SECTION 4. That the Zoning Ordinance and Map of the City of Corpus
Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time,
except as herein changed, shall remain in full force and effect.
SECTION 5. That all ordinances or parts of ordinances in conflict herewith
are hereby expressly repealed.

SECTION 6. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for efficient
administration of City affairs by granting the aforesaid zoning change, such finding of an
emergency is made and declared requiring suspension of the Charter rule as to consideration
and voting upon ordinances at three regular meetings so that this ordinance is assed and
shall take effect upon first reading as an emergency measure this the day of

For the reasons set forth in the emergency clause of the foregoing
ordinance an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances at three regular
meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance finally on the date it is introduced, or at
the present meeting of the City Council.
