AUTHORIZING THE CONVEYANCE AND THE EXECUTION OF A
DONATION DEED TO THE STATE OF TEXAS FOR A 0.208 ACRE TRACT
FOR A TURN LANE OFF S.H. 286 TO THE ELLIOTT LANDFILL; AND
DECLARING AN EMERGENCY.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS:
SECTION 1. That the City Manager is hereby authorized to execute a Donation
Deed to convey to the State of Texas a 0.208 acre tract for a turn lane off S.H. 286 to the
Elliott Landfill; as more fully set forth in the deed, a substantial copy of which is attached
hereto as Exhibit A.
SECTION 2. That upon written request of the Mayor or five council members,
copy attached, to find and declare an emergency due to the need for the efficient and effective
administration of City affairs, such finding of an emergency is made and declared requiring
suspension of the Charter rule as to consideration and voting upon ordinances at three regular
meetings so that this ordina ce is passed nd shall take e ect upon first reading as an

KNOW ALL BY THESE PRESENTS:
COUNTY OF NUECES
That THE CITY OF CORPUS CHRISTI of the County of Nueces, State
of Texas, for and in consideration of the sum of Ten Dollars and no
cents ($10.00) and other good and valuable consideration to IT in
hand paid by the STATE OF TEXAS, Nueces County, Texas has given and
transferred and by these presents does hereby give and transfer
unto the STATE OF TEXAS the following described tract or parcel of
land, situated in Nueces County, Texas, to -wit:
See the metes and bounds property description
attached hereto and made a part thereof for all purposes
as "Exhibit A".
A map showing the location of the acquisition is
attached hereto and made a part hereof for all purposes
as "Exhibit B".
For the purpose of constructing a roadway upon said tract for
public use, or for other public purposes.
This conveyance is made and accepted subject to any and all
instruments of record, other than lien instruments, affecting the
hereinabove described property, including restrictive covenants,
easements, rights-of-way, leases, mineral and/or royalty
reservations previously reserved to predecessors in title or
heretofore transferred or assigned, and/or oil and gas leases; and
to zoning and regulatory ordinances outstanding and affecting the
hereinabove described property.

BEING A 9,070 SQUARE FOOT (0.208 AC.) STRIP OF LAND ALONG AND ADJACENT TO THE
NORTHWEST RIGHT-OF-WAY OF A 100.0 FOOT WIDE ROAD KNOWN AS STATE HIGHWAY NO.
286 (CHAPMAN RANCH ROAD), OUT OF LOT 3, SECTION 14 OF BOHEMIAN COLONY LANDS,
A MAP OF WHICH IS RECORDED IN VOLUME A, PAGE 48, OF THE MAP RECORDS OF NUECES
COUNTY, TEXAS AND BEING MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS AS
FOLLOWS;
Beginning at a point on the Northwest right-of-way line of said State Highway
No. 286, at it's intersection with the common boundary line of said Lot 3 and
Lot 4, Section 14 of said Bohemian Colony Lands, for the South corner of this
tract, from which point the South corner of said Lot 3 bears, South 61°00'00"
East, 50.00 Feet;
Thence, North 61°00'00" West, with said common boundary line of Lots 3 and 4,
a distance of 10.00 feet, to a point, for the west corner of this tract;
Thence, North 29°00'00" East, parallel with and 10.00 feet distant therefrom
said Northwest right-of-way line, of State Highway No. 286 a distance of
907.00 feet, to a point, for the North corner of this tract;
Thence, South 61°00'00" East, a distance of 10.00 feet, to a point on said
Northwest right-of-way line of State Highway No. 286, for the East corner of
this tract;
Thence, South 29°00'00" West, with said Northwest right-of-way line of State
Highway No. 286, a distance of 907.00 feet, to the PLACE OF BEGINNING and
containing 9,070 square feet (0.208 AC.) of land.

For the reasons set forth in the emergency clause of the foregoing ordinance an emergency
exists requiring suspension of the Charter rule as to consideration and voting upon
ordinances at three regular meetings; I/we, therefore, request that you suspend said Charter
rule and pass this ordinance finally on the date it is introduced, or at the present meeting
of the City Council.
