HomeMy WebLinkAbout021121 ORD - 03/26/1991ORDINANCE AMENDING THE PLATTING ORDINANCE, SECTION IV. DESIGN STANDARDS, H. LARGE TRACT DIVISION, BY ADDING PARAGRAPH (4) PERMITTING SINGLE-FAMILY SUBDIVISIONS OF ONE (1) ACRE LOTS OR MORE OUTSIDE THE CITY LIMITS TO BE DEVELOPED WITHOUT CURBS, GUTTERS, AND SIDEWALKS, SUBJECT TO COMPLIANCE WITH SIX (6) REQUIREMENTS; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Platting Ordinance, the same being Ordinance No. 4168, as amended, on file with the City Secretary and codified as Chapter 42 of the City code of Ordinances, is hereby amended by adding paragraph (4) to Section IV, Design Standards. H. Large Tract Division, to read as follows: Section IV. Design Standards, H. Large Tract Division. (4) For land located outside the City Limits and being subdivided for single-family residential purposes of lots on one (1) acre or more, curbs, gutters, and sidewalks are not required provided the following requirements are met: (a) The right-of-way and pavement section (excluding curb, gutter, and sidewalks), as required by the Corpus Christi Comprehensive Plan is provided and dedicated; (b) The subdivision contains a minimum of thirty (30) lots and does not exceed a maximum of one -hundred and twenty (120) lots; (c) Deed restrictions include provision that if any lots are subdivided to less than one (1) acre, the entire subdivision is to be replatted and all required improvements are provided. The cost of any future improvements, whether through replatting or by property owner's petition to the City, shall be at the owner's expense and not assumed by the City; (d) Open drainage ditches to be permitted only if design capacity requirements can be met by ditches which are no more than one (1) foot deeper than the adjacent pavement or finished ground level, if not within the street right-of-way; ORD4: 91067 021121 MtCROFaMED (e) Public water service shall be provided to all lots. The water system shall be designed in accordance with the Distribution System Standards published by the Water Division, Corpus Christi, Texas, in effect at the time of commencement of water system construction. Public sanitary sewer service shall be provided to all lots if reasonably available to the nearest point to the subdivision; or if sewer service is not reasonably available, deed restrictions shall require connection to each developed lot when sewer service becomes reasonably available to such lot; (f) If located within one-half (1/2) mile of an established AICUZ boundary, disclosure statements are included in the deed restrictions which indicate latest noise levels for the area being subdivided. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. That upon written request of the Mayor or five council members, copy attached, to find and declare an emergency due to the need for the efficient and effective administration of City affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at three regular meetings so that this ordin ice is passed and shall take effect upon first reading as an emergency measure this the (�i day of A, tot (' i I , 196/ l .
