CALLING A RUNOFF ELECTION FOR THREE (3)
COUNCIL MEMBERS IN THE CITY OF CORPUS
CHRISTI, TEXAS, TO BE HELD ON THE 20TH DAY OF
APRIL, 1991; DESIGNATING POLLING PLACE
LOCATIONS FOR SUCH ELECTION; ENACTING
PROVISIONS INCIDENT AND RELATING TO THE
SUBJECT AND PURPOSE OF THIS ORDINANCE; AND
DECLARING AN EMERGENCY.
WHFREAS, the City Charter provides for the holding of a regular City election
for Mayor and eight (8) Councilmembers in the City of Corpus Christi on the first Saturday
in April in odd -numbered years, the same being April 6, 1991;
WHEREAS, it is provided in the Texas Election Code, as amended, of the
State of Texas that the governing bodies shall order elections pertaining to municipal affairs,
give notice, and appoint officers to conduct the election;
WHEREAS, the Election Code requires runoff elections in the event that any
candidate for Mayor or Council Member fails to receive a majority of all votes cast for such
office at any regular municipal election, at which runoff election the two candidates receiving
the highest number of votes for such office in the first election shall again be subject to a
vote of the qualified voters;
WHEREAS, Article II, Section 3, of the City Charter sets runoff election for
the second Saturday following the regular election; and
WHEREAS, the official canvass of the election returns of the regular election
duly held for the office of Mayor and Councilmembers has been duly had in accordance with
State law and City Charter requirements; and inasmuch as none of the candidates for the
office of Counci member in District 1, District 2, and District 4 received a majority of all
votes cast at said regular election, held on April 6, 1991, for such office, there is hereby
declared a necessity for a runoff election.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF CORPUS CHRISTI, TEXAS:
SECTION 1. That a runoff election for the election of Councilmembers in
District 1, District 2, and District 4 in the City of Corpus Christi, shall be held in the City
of Corpus Christi on April 20, 1991, with the names of the following candidates for the
respective office as follows:

SECTION 2. That at said election herein ordered all the qualified voters of
the City of Corpus Christi shall be permitted to vote.
SECTION 3. That the names of candidates for the office of the City
Councilmembers shall be place on said ballot in the manner and form prescribed by law.
SECTION 4. That voting machines shall be employed at the election herein
ordered in accordance with the provisions of the Election Code, and said election shall be
held at the polling places in the regularly prescribed precincts of the City of Corpus Christi,
such voting precincts and polling places being set forth on Attachment A hereto,
incorporated by reference and made a part of this ordinance. Said election shall be held in
accordance with the election laws of the State of Texas. The polls shall be open from
7:00 a.m. to 7:00 p.m. on the day of the election.
SECTION 5. The City Secretary, Armando Chapa, whose office is situated
at the Office of the City Secretary, First Floor, City Hall, 1201 Leopard Street, Corpus
Christi, Texas, is hereby appointed as the authority and officer responsible for the conduct
of said election and is hereby authorized and directed to make all necessary arrangements
for the holding of said election in accordance with and subject to the laws of this State. The
City Secretary is hereby appointed the Absentee Voting Clerk for absentee voting. Absentee
voting shall be conducted at the absentee polling places as provided herein.
SECTION 6. Voting machines shall be used for the conduct of said election
on election day and paper ballots shall be used for conducting absentee voting. Absentee
voting in person shall be conducted from 8:00 a.m to 5:00 p.m., Monday through Friday,
beginning on April 11, 1991, and ending April 16, 1991, and on Saturday, April 13, 1991.
Absentee voting in person may be conducted at the main absentee polling place located in
the lobby of City Hall, the same being designated as the office of the City Secretary, 1201
Leopard, or at the temporary branch polling places hereby established as follows:

Each branch polling place and the main absentee polling place shall serve all election
precincts.

SECTION 7. The City Secretary is directed to post and publish such election
notices as are required by the Election Laws of the State of Texas.
SECTION 8. By approving and signing this ordinance, the Mayor officially
confirms as her action all matters recited in this ordinance which by law come within her
jurisdiction.
SECTION 9. If for any reason any section, paragraph, subdivision, clause,
phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final
judgment of a court of competent jurisdiction, it shall not affect any other section,
paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the
definite intent of this City Council that every section, paragraph, subdivision, clause, phrase,
word or provision hereof be given full force and effect for its purposes.
SECTION 10. The fact that it is necessary and essential that the governing
body of the City of Corpus Christi shall order elections pertaining to municipal affairs, that
the notice of such election should be promptly posted and published and that a runoff
election for the election of three Council members in the City of Corpus Christi shall be held
on the 20th day of April, 1991, and immediate action is necessary for the efficient and
effective administration of the City's affairs to comply with all applicable laws, creates a
public emergency and an imperative public necessity requiring the suspension of the Charter
rule that no ordinance shall be passed finally on the date of its introduction but that such
ordinance shall be read at three regular meetings of the City Council, and the Mayor, having
declared that such emergency and necessity exist, having requested the suspension of the
Charter rule and that this ordinance be passed finally on the date of its introduction and
