HomeMy WebLinkAbout021143 ORD - 04/23/1991AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION BY EXIQUIO "KIKO" BARRERA BY GRANTING A SPECIAL COUNCIL PERMIT FOR A PARKING LOT SUBJECT TO FIVE (5) CONDITIONS ON LOT 3, BLOCK 3, GARDENDALE NO. 1; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Exiquio "Kiko" Barrera for amendment to the zoning map of the City of Corpus Christi. WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Tuesday, April 23, 1991, during a meeting of the City Council in the Council Chambers at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That a Special Council Permit be granted on Lot 3, Block 3, Gardendale No. 1, located on the south side of Bonner Drive, approximately 225 feet east of Everhart Road, situated in the City of Corpus Christi, Nueces County, Texas, in accordance with the following site plan and use: 1. USES: The only uses authorized by this Special Permit other than the basic "R -1B" One -family Dwelling District uses, is a parking lot to serve adjacent land fronting Everhart Road. 2. SETBACKS: A 25 foot building and parking setback from the Bonner Drive right-of-way line shall be maintained, except that only one driveway may be permitted through the setback area. 3. SCREENING: A six (6) foot tall solid screening fence shall be maintained along the south and east boundary lines of Lot 3, Block 3, Gardendale No. 1. The screening fence along the east boundary must be set back 25 feet from the Bonner Drive right-of-way line. RP1100.005.kp Y 021143 MICROFILMED 4. J,IGHTING: All lighting on the property must be shielded and directed away from the single-family residential area. 5. LANDSCAPING: As part of fulfilling the requirements of the Landscaping Ordinance, a minimum of four (4), 5 -inch minimum caliper mesquite trees must be located within the 25 foot front yard setback area. In the event the Board of Adjustment grants any special exception or variance to the Zoning Ordinance, applicable to the Special Permit herein granted, other than the one specified in this Special Permit, said Special Permit shall be void and of no force and effect whatsoever. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at three regular meetings so that this ordinance is passed and shall take effect uppv first reading as an emergency measure this the ,� day of (tarip 1991.
