HomeMy WebLinkAbout021144 RES - 04/23/1991A RESOLUTION SUPPORTING LEGISLATION REVERSING THE RESULT OF THE COURT OF CRIMINAL APPEALS DECISION REGARDING PROOF NECESSARY TO ESTABLISH LACK OF FINANCIAL RESPONSIBILITY WHEREAS, it is essential that state laws requiring drivers to be financially responsible be enforceable; WHEREAS, on April 10, 1991, the Texas Court of Criminal Appeals held in Coit v. State, that it is insufficient to prove lack of financial responsibility by showing that a driver produced no evidence of insurance; WHEREAS, this ruling is contrary to longtime practice and severely inhibits enforcement; and WHEREAS, legislation is urgently needed to correct this ruling. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City of Corpus Christi supports legislation effective immediately, to provide for conviction for failure of a driver to present tangible evidence of financial responsibility as prescribed by law. SECTION 2. That the City Manager and staff are directed to advise all local legislators and other pertinent officials of this resolution, and to take all steps necessary to support bills overturning the result in Coit v.
