PROHIBITING RELEASE OF LIGHTER THAN AIR BALLOONS; PROVIDING
FOO EXCEPTIONS, SEVERABILITY AND PUBLICATION AS A PENAL
ORDINANCE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS:
SECTION 1. That City Code Chapter 21, Garbage. Trash And Other Refuse
Article I, $i General, is hereby amended by adding a new Section 21-32, Release of balloons. to
read as follows:
Seat 21-32. Release of balloons.
A. A person commits an offense if the person knowingly releases a
balloon into the air outside a roofed structure.
B. A person commits an offense if the person organizes or promotes an
event during which balloons are released into the air outside a
roofed structure if the person knew that such release was planned or
authorized.
C. It is an affirmative defense to prosecution under this section that the
balloon was released for scientific or meteorological purposes by or
authorized by a government agency, or that the balloon was a hot
air balloon designed for recovery after launching.
D. As used in this section, "balloon" means an inflatable bag of thin
rubber or similar material inflated with lighter than air gas.
SECTION 2. If for any reason any section, paragraph, subdivision, clause,
phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final
judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph,
subdivision, clause, phrase, word or provision of this ordinance for it is the definite intent of this
City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof
be given 6tll force and effect for its purpose.
SECI"ON 3. Publication shall be made one time in the official publication of the
City of Corpus Christi by publishing the caption stating in substance the purpose of the
ordinance` this ordinance to become effective upon such publication.
