HomeMy WebLinkAbout021180 RES - 06/11/1991RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH THE CORPUS CHRISTI INDEPENDENT SCHOOL DISTRICT WHICH PROVIDES $50,000 AS THE SCHOOL DISTRICT'S COST IN CONSTRUCTING A PARK AND DRIVE FACILITY IN FRONT OF THE WYNN SEALE MIDDLE SCHOOL; AND APPROPRIATING $50,000 AS FUNDS TO BE RECEIVED FROM THE SCHOOL DISTRICT APPLICABLE TO PROJECT NO. 220-601-602.23-593, AYERS STREET/BALDWIN TO SANTA FE. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager is hereby authorized to execute an agreement with the Corpus Christi Independent School District which provides $50,000 as the school district's cost in constructing a park and drive facility in front of the Wynn Seale Middle School, as more fully set forth in the Agreement, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A." SECTION 2. Appropriating $50,000 as funds to be received from the school district applicable to Project No. 220-601-602.23-593, Ayers Street/Baldwin to Santa Fe. WHEREAS, the City has prepared plans for the improvement of Ayers Street from Santa Fe Street to Baldwin Blvd., and WHEREAS, the District, being owners of the Wynn Seale School desire to make certain improvements to the parking lot at said school concurrently with the improvements to Ayers Street; NOW, THEREFORE, the City and District agree as follows: 1. The City will include the improvements to the District's parking lot in the construction contract for the improvements to Ayers Street. The parking lot improvements are as shown in City Drawings, Str. 663. All work shall be done in accordance with the plans and specifications for the project as prepared by the City's Department of Engineering Services. 2. The District shall pay to the City the actual cost of construction of the aforesaid improvements to the parking lot. The cost of construction is as shown on Appendix "B" to the Special Provisions of the Construction Contract attached hereto and made a part hereof. Appendix "B" and the Construction Cost Breakdown are included for informational purposes only and the cost of said improvements shall be based on the actual contract lump sum price. 3. Upon award of the contract by the City, the District will pay the City, upon proper invoicing, the cost of the parking lot improvements within thirty (30) days of the invoice date. 4. This agreement shall in no way affect the City's assessing the District for their proportionate share of the cost of the improvements to Ayers Street as specified by City Ordinance. 5. The District shall not restrict public access to the sidewalk along the north property frontage along Ayers Street. 6. The District and the City enter into this Agreement pursuant to Article 4413 (32c), Interlocal Cooperation Act, as amended. Neither party shall be responsible to the other for personal injuries, losses, claims, or demands caused by the acts or omissions, if any, of such party or its agents, employees, Agreement - CCISD Ayers street/wynn Seale School Page 1 of 2 EXHIBIT "A'' invitees, or subcontractors. The liability, if any, of either party shall be that prescribed by the laws of the State of Texas. 7. The Agreement shall become effective and shall be binding upon and shall inure to the benefit of the parties hereto. This Agreement is solely for the benefit of the District and the City, and is not for the benefit of any third party. Exp. 8-4-91 218 APPENDIX B SPECIAL SPECIFICATION FOR WYNN SEALE - PARK AND DRIVE 1. DESCRIPTION: This specification shall govern the removal, excavation, adjustment, relocation, and construction of all the items necessary to complete the park and drive facilities at Wynn Seale Junior High School as specified herein and as shown on the plans. 2. MATERIALS AND CONSTRUCTION METHODS: The materials and methods of construction for the above described structure shall be done in accordance with the respective specification of the particular item under construction. 3. MEASUREMENT: The park and drive facilities shall be measured per each and shall be a complete in-place structure, approved by the Engineer. Construction of this item shall involve all the estimated quantities tabulated below, which shall not be individually measured for payment and are shown for the Contractor's estimating convenience only.
