AMENDING THE ZONING ORDINANCE UPON APPLICATION OF NICHOLS
SOUTHSIDE PHARMACY, INC. BY GRANTING A SPECIAL COUNCIL
PERMIT FOR AN AUTOMOBILE WHOLESALE USE ON LOT 1-R, BLOCK 2,
SOUTHWOOD ADDITION; AND DECLARING AN EMERGENCY.
WHEREAS, the Planning Commission has forwarded to the City Council its reports
and recommendations concerning the application of Nichols Southside Pharmacy, Inc. for
amendment to the zoning map of the City of Corpus Christi;
WHEREAS, in accordance with proper notice to the public, a public hearing was held
on Tuesday, June 18, 1991, during a meeting of the City Council in the Council Chambers Hall in
the City of Corpus Christi allowing all interested persons to appear and be heard; and
WHEREAS, it was decided by the City Council that to approve the hereinafter set
forth amendment would best serve public health, necessity and convenience and the general welfare
of the City of Corpus Christi and its citizens.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is
amended by making the change hereinafter set out.
SECTION 2. That a Special Council Permit be granted on Lot 1-R, Block 2,
Southwood Addition, for an automobile wholesale use, located on the southeast corner of
Southwood Street and Gollihar Road, situated in the City of Corpus Christi, Nueces County, Texas,
in accordance with the site plan attached as Exhibit "A," subject to the following conditions:
1. USE: The only use authorized by this Special Council Permit other than the basic
"B-1" Neighborhood Business District uses, is an automobile wholesale use with an
accessory auto detail shop. All automobiles must be in an operable condition.
2. LANDSCAPING: The south seventy (70') feet of the west one hundred twenty (120')
feet of the property must provide landscaping in accordance with Article 27B,
"Landscape Requirements" as if new construction. All landscaping must be installed
within one (1) year of the date of this ordinance.
3. SCREENING: A chain link fence with permanent slats and with a minimum height
of six (6') feet must be provided along the south boundary and the south seventy
(70') feet of the west boundary line. The screening fence must be located behind the
landscaped area along Southwood Street and must not penetrate the visibility
triangle.

4. ACCESS: No vehicular access shall be permitted from the south seventy (70') feet
of the property to Southwood Street. Only one (1) access point with a maximum
width of thirty-five (35') feet may be permitted from the property to the alley.
5. LIGHTING: All site lighting must be shielded and directed downward and away
from the surrounding residential properties and public rights-of-way so as to reduce
glare.
6. SOUND SYSTEMS: The use of outside speakers, microphones, or public address
systems on the property are prohibited.
In the event the Board of Adjustment grants any special exception or variance to the
Zoning Ordinance, applicable to the Special Permit herein granted, other than the one specified
in this Special Permit, said Special Permit shall be void and of no force and effect whatsoever.
SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be
and the same is hereby amended as herein ordained.
SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi,
Texas, approved on the 27th day of August, 1973, as amended from time to time, except as herein
changed, shall remain in full force and effect.
SECTION 5. That all ordinances or parts of ordinances in conflict herewith are
hereby expressly repealed.
SECTION 6. That upon written request of the Mayor or five Council members, copy
attached, to find and declare an emergency due to the need for efficient administration of City
affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared
requiring suspension of the Charter rule as to consideration and voting upon ordinances at three
regular meetings so that this ordinance is sassed and shall take effect upon first reading as an
emergency measure this the (9, day of L , 1991.

exists requiring suspension of the Charter rule as to consideration and voting upon ordinances at

ordinance finally on the date it is introduced, or at the present meeting of the City Council.
