HomeMy WebLinkAbout021207 ORD - 08/06/1991AN ORDINANCE AMENDING THE CODE OF ORDINANCES, CHAPTER 19, FOOD AND FOOD ESTABLISHMENTS, SECTION 19-33(b) ISSUANCE FEE, TO INCREASE THE FEES FOR ISSUANCE OF HEALTH PERMITS FOR FOOD ESTABLISHMENTS; AND PROVIDING FOR PUBLICATION. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Code of Ordinances, Chapter 19, FOOD AND FOOD ESTABLISHMENTS, SECTION 19-33(b), is hereby amended by deleting it in its entirety and substituting as follows: (b) Prior to the issuance of a health permit, the applicant shall pay a fee according to the following schedule: Food service or food processing establishments: Having more than one hundred (100) employees $400.00 Having seventy-six (76) through ninety-nine (99) employees 350.00 Having fifty-one (51) through seventy-five (75) employees 300.00 Having twenty-six (26) through fifty (50) employees 250.00 Having nineteen (19) through twenty-five (25) employees 200.00 Having nine (9) through eighteen (18) employees 150.00 Having four (4) through eight (8) employees 125.00 Having fewer than four (4) employees 75.00 Temporary food service establishments 25.00 Retail food stores 75.00 Mobile units 75.00 Frozen desserts 60.00 Late fee 25.00 MISC:91163 skp (1) No fee will be charged for a food service operation conducted by a taxing authority, such as a school district, whether local, state, or federal. (2) For permanent establishments, the fee shall be reduced by twenty-five (25) per cent if the permit is issued in April, May, or June; by fifty (50) per cent if the permit is issued in July, August, or September; and seventy-five (75) per cent if the permit is issued in October, November, or December. The minimum fee shall be twenty-five dollars ($25.00). 021207 SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. Publication shall be made one time in the official publication of the City of Corpus Christi by publishing the caption stating in substance the purpose of the ordinance, this ordinance to become effective upon such publication.
