HomeMy WebLinkAbout021216 ORD - 08/13/1991AN ORDINANCE ASSESSING A COURT COST OF $1.00 FOR EACH VIOLATION OF AN ORDINANCE, REGULATION OR ORDER REGULATING THE STOPPING, STANDING, OR PARKING OF VEHICLES; LIMITING USE OF SUCH FUNDS TO A SCHOOL CROSSING GUARD PROGRAM WITH ANY EXCESS TO BE USED FOR OTHER CHILI) PROTECTIVE PROGRAMS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR PUBLICATION NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Chapter 53 Traffic Article VI, Standing and Parking, Division 1, Generally, of the Corpus Christi Code of Ordinances, is hereby amended by adding a new section 53-153, Court costs, to read as follows: Sec. 53-153. Court costs. A. There is hereby assessed a court cost of $1.00 on each parking violation. "Parking violation" shall include a violation of any City ordinance, regulation, or order regulating the stopping, standing, or parking of vehicles, which presently exists or nay be subsequently adopted. This section is adopted pursuant to Article 102.014 of the Texas Local Government Code. B. The Municipal Court or other city agency which may be authorized to collect fines or assessments for parking violations shall collect the court cost provided for herein. C. The money received from court costs hereunder shall be used for the City's school crossing guard program. If it exceeds the amount necessary for said program such money may be depositied in an interest-bearing account or expended for programs designed to enhance child safety, health, or nutrition, including child abuse prevention and intervention and drug and alcohol abuse prevention, and such other purposes as are hereafter authorized by State law. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction. it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose.
