HomeMy WebLinkAbout021219 ORD - 08/13/1991AN ORDINANCE CLOSING A 10 -FOOT WIDE BY APPROXIMATELY 134 -FOOT LONG PEDESTRIAN WALKWAY BETWEEN LOT 20, BLOCK 1, AND BLOCK A, CARROLL PLACE ADDITION, SUBJECT TO SPECIFIED CONDITIONS AND RETAINING THE WALKWAY AS A UTILITY EASEMENT, AND DECLARING AN EMERGENCY. WHEREAS, there exists a 10 -foot wide by approximately 134 -foot long pedestrian walkway between Lot 20, Block 1, and Block A, Carroll Place Addition; WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said walkway easement, subject to the provisions listed below: 1. Crane's Landing Apartments, Block A, Carroll Place Addition, will relinquish their five feet of the walkway to the owner of Lot 20, Block 1, Carroll Place Addition; 2. The owner of Lot 20, Block 1, Carroll Place Addition, will fence in and maintain the right-of-way in lieu of payment of the fair market value of the walkway; 3. The walkway will be retained by the City as a utility easement; and 4. The City will replat the property. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI: SECTION 1. That a 10 -foot wide by approximately 134 -foot long pedestrian walkway between Lot 20, Block 1, and Block A, Carroll Place Addition, be and the same is hereby closed for public use, subject to the property being replatted at City's expense, and the City retaining a utility easement across the walkway, further subject to Crane's Landing Apartment relinquishing their five feet of the walkway to the owner of Lot 2, Block 1, Carroll Place Addition, and further subject to the owner of Lot 20, Block 1, Carroll Place Addition, fencing in and maintaining the right-of-way in lieu of payment of the fair market value of the walkway. SECTION 2.
