PROHIBITING AN OWNER, OPERATOR OR EMPLOYEE OF A
BUSINESS ESTABLISHMENT FROM KNOWINGLY ALLOWING A
MINOR ON THE ESTABLISHMENT PREMISES IN VIOLATION OF
CURFEW; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR
PUBLICATION
people; and
WHEREAS, this community has no more important asset than its young
WHEREAS, young people are vulnerable to adverse societal pressures such
as crime, drug usage, and other influences to a degree that adults are not; and
WHEREAS, parental responsibility and supervision have declined, and the
community has a vital interest in protecting its children; and
WHEREAS, the curfew in Sections 33-40 and 33-41 of the City Code has been
enacted to protect young people from harm, to enforce parental responsibility, to protect
the public from vandalism, and to reduce youth crime; and
WHEREAS, business establishments which knowingly permit young people on
their premises in violation of curfew encourage lawbreaking and contribute to behavior
detrimental to young people and to the community.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF CORPUS CHRISTI, TEXAS:
SECTION 1. That Chapter 33, Offenses and Miscellaneous Provisions , of the
Corpus Christi Code of Ordinances, Article II, Minors, be amended by adding a new Section
33-42.1, Permitting curfew violation on premises, to read as follows:
Sec. 33-42.1. Permitting curfew violation on premises.
A. The owner, operator, or any employee of an establishment commits an
offense if he knowingly allows a minor to enter or remain upon the premises
of the establishment in violation of Section 33-40 of this Code.

B. In this section:
1. "Establishment" means any privately -owned place of business
operated for a profit to which the public is invited, including
but not limited to any place of amusement or entertainment.
2. "Operator" means any individual, firm, association,
partnership, or corporation operating, managing, or conducting
any establishment, including the members or partners of an
association or partnership and the officers of a corporation.
3. "Premises" means the structure within which the
establishment is housed.
SECTION 2. If for any reason any section, paragraph, subdivision, clause,
phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final
judgment of a court of competent jurisdiction, it shall not affect any other section,
paragraph, subdivision, clause, phrase, word or provision of this ordinance for it is the
definite intent of this City Council that every section, paragraph, subdivision, clause, phrase,
word or provision hereof be given full force and effect for its purpose.
SECTION 3. Publication shall be made in the official publication of the City
of Corpus Christi as required by the City Charter of the City of Corpus Christi.
