HomeMy WebLinkAbout021249 ORD - 09/24/1991AN ORDINANCE AMENDING THE ZONING ORDINANCE, ARTICLE 26, NONCONFORMING USES BY REPEALING SECTIONS 26-1, 26-8, AND 26-9. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance, Article 26 Nonconforming Uses by repealing Sections 26-1, 26-8, and 26-9: ARTICLE 26. NONCONFORMING USES Section 26-1 (Reserved) . Section 26-8 (Reserved) Existing owner -occupied mobile homes which become nonconforming as to use due to a City Council, City Manager, or Planning Commission initiated zoning map change may be restored despite the "Destruction of a Nonconforming Use" section of this Article provided' 1. That after January 1. 1992. such use has not ceased or terminated for a period greater than one year. 2. The restoration is conforming in all ways except as to allowable use as a mobile home. In districts without allowable residential uses. dimensional requirements shall be as contained in the "R -1C" District. 3. The mobile home remains owner -occupied. 4. Restoration is complete within six (6 months of the date of damage, Upon written request from the owner. the Building Official may extend the restoration period up to an additional six (6) months if he finds that substantial progress in restoring the mobile home has been made. In no case shall the total restoration period exceed twelve (12) month from the date of damage. Owner -occupancy status shall require ownership of the mobile home and the lot on which it sits. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. Publication shall be made one time in the official publication of the City of Corpus Christi by publishing the caption stating in substance the purpose of the ordinance, this ordinance to become effective upon such publication.
