AMENDING THE ZONING ORDINANCE, ARTICLE 27 SUPPLEMENTARY HEIGHT. AREA. AND
BULK REOUIREMENTS, BY AMENDING SECTION 27-3.0466.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS;
SECTION 1. That the Zoning Ordinance, Article 27, Supplementary Height. Area. and Bulk
Requirements by amending Section 27-3.04-06 as follows:
27-3.04 Side Yards:
Section 27-3.04.0 For multiple -family structures and accessory structures located
steries-edeas within a water oriented subdivision, due to the openness created by the permanent tyros%
waterways abutting the lots the required side yard may be modified to deviate from the
requirements of Article 24 of this ordinance as follows:
(1) A minimum five (5) foot side yard on one side with a minimum total of fifteen (15) feet on the
two side yards are maintained for structures not exceeding a height of three (3) stories or 35
feet:
(2) Any part of a structure exceeding a height of three (3) stories or 35 feet shall be set back an
additional five (5) feet on each side yard for each additional story or fifteen (15) foot increase
in height
In no case shall the minimum required side yard for each side exceed 35 feet
44,1 When a side yard is contiguous to property in a zoning district with more demanding side yard
requirements. the minimum side yard shall be equal to or greater than the more demanding
side yard requirement.
A water oriented subdivision is a subdivision along any bay, gulf, cove, canal, lagoon, or pass, and shall
be a marina type development which shall include canals, channels, and waterways adjacent to at least
20 percent of the lots within the subdivision.
SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision
of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall
not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance for it is the
definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be
given full force and effect for its purpose.
SECTION 3. Publication shall be made one time in the official publication of the City of Corpus Christi
by publishing the caption stating in substance the purpose of the ordinance, this ordinance to become effective upon such
publication.
