HomeMy WebLinkAbout021263 ORD - 10/08/1991AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF THE BOAT HOUSE BY GRANTING A SPECIAL COUNCIL PERMIT FOR A BOAT STORAGE AND RENTAL FACILITY SUBJECT TO FIVE (5) CONDITIONS ON 0.264 ACRE OUT OF THE SOUTH CORNER OF BLOCK B, BROOKLYN ADDITION; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of The Boat House for amendment to the zoning map of the City of Corpus Christi. WHEREAS, in accordance with proper notice to the public, a public hearing was held on Tuesday, October 8, 1991, during a meeting of the City Council in the Council Chambers at City Hall in the City of Corpus Christi allowing all interested persons to appear and be heard; and WHEREAS, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That a Special Council Permit be granted on 0.264 acre out of the south corner of Block B, Brooklyn Addition, as more specifically described by metes and bounds on Exhibit A attached hereto, situated in the City of Corpus Christi, Nueces County, Texas, for a boat storage and rental facility subject to five (5) conditions, in accordance with the following site plan and use: Rr1840.024.kp 1) USE: The only uses authorized by this Special Permit other than the basic "AT' Apartment -Tourist District uses, are the rental and the limited outside storage of non -motorized boats and retail sale of small parts for boats. The Special Permit shall remain valid as long as the applicant's Park and Beach Use Permit is valid. 2) OUTSIDE STORAGE: The outside storage shall not contain more than thirty (30) non -motorized boats. The boats must be functional/operable at all times. 1 021263 3) PARKING. A minimum of four (4) parking spaces must be provided for the uses authorized by this Special Permit. All parking spaces and area must comply with the standards set forth in Article 22, "Parking Regulations" of the City of Corpus Christi Zoning Ordinance, as amended. 4) LIGHTING: All site and parking lot lighting must be shielded and directed downward and away from the surrounding properties and public rights-of-way so as to reduce glare. 5) PROPERTY BOUNDARY: Before the issuance of a certificate of occupancy, the owner or user must provide verification that the uses are wholly contained within the private property boundaries unless a Use Permit allows the uses to be located on public property. In the event the Board of Adjustment grants any special exception or variance to the Zoning Ordinance, applicable to the Special Permit herein granted, other than the one specified in this Special Permit, said Special Permit shall be void and of no force and effect whatsoever. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the % day of19jI . STATE OF TEXAS COUNTY OF NUECES Description of 0.264 acres of land, more or less, out of the 9.461 acre tract known as Block 8, Brooklyn Addition as re- corded in Volume 23, Page 14, Map Records of Nueces County, Texas, and more fully described by metes and bounds as follows; BEGINNING at a 3/4" iron pipe•found for the Southernmost corner of this tract and of said Block.8, said 3/4" iron pipe being in the Northeast right-of-way line of Avenue C; THENCE N60°41'00"W with the South line of this tract and said Block B, with the said Northeast right-of-way line of Ave- r;ue C 51.89 feet to a 3/4" iron pipe for the point of curvature of a circular curve to the right, said circular curve to the right having a central angle'of.02°03'48", a radius of 504.72 feet and a tangent length of 9.09 feet; THENCE with the arc of said curve to the right and with the said Northeast right-of-way line of Avenue C, a distance of 18.18 feet to a point for the Westernmost corner of this tract; THENCE N32°00'00"E 165.95 feet to a point being the Northern- most corner of this tract; THENCE S58°00'00"E 70.00 feet to a point being the Northeast corner of this tract; THENCE 532°00'00"W with the Southeast boundary of this tract and of said Block B, 163.00 feetto the POINT OF BEGINNING.
