HomeMy WebLinkAbout021265 ORD - 10/22/1991AN ORDINANCE AMENDING THE ORIGINAL BOUNDARIES OF THE CORPUS CHRIST[ ENTERPRISE ZONE AND AUTHORIZING THE FILING OF AN ENTERPRISE ZONE EXPANSION APPLICATION WITH THE TEXAS DEPARTMENT OF COMMERCE. WHEREAS, the City Council of the City of Corpus Christi, Texas, (the "City") has recognized the importance of economic development to the City; and WHEREAS, the City has determined that there are benefits for the City and the County which may be derived from having an Enterprise Zone Program in accordance with the Texas Enterprise Zone Act, Texas Revised Civil Statutes Article 5190.7 (the "Act"); and WHEREAS, the City has directed the City Manager to develop a City of Corpus Christi Enterprise Zone Program and to recommend definite geographical boundaries and specific economic development incentives of such Enterprise Zone Program; and, WHEREAS, the Act contemplates nomination by the City to the Texas Department of Commerce, of any economically distressed area within the City which meets the criteria of the Act as a potential enterprise zone; and WHEREAS, in accordance with the Act, the Texas Department of Commerce heretofore approved, on November 22, 1989, the nomination of the City of Corpus Christi Enterprise Zone ("Zone") as an enterprise zone pursuant to the City's Resolution No. 20806; and WHEREAS, the City now desires to amend the boundaries of the Zone in accordance with Section 4(d) of the Act, which section establishes an application process for the expansion of the boundaries of an existing enterprise zone such as the Zone; and WHEREAS, in compliance with section 4(d) of the Act, on October 8, 1991, the City held a public hearing to consider expanding the boundaries of the Zone; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI: SECTION 1. The current original boundaries of the Zone, more particularly described on Exhibit A, (original metes and bounds description) attached hereto and incorporated herein for all purposes are hereby amended and expanded to encompass the area within the City more particularly described on Exhibit B (expansion area described by metes and bounds), and all such areas described on Exhibits A and B shall be hereinafter singly named and referred to as the "Corpus Christi Enterprise Zone" Opp 021265 dt II Vii,. (the Zone, including the Expansion Area, is hereinafter referred to as the "Expanded Zone"). SECTION 2. The City has determined and finds that the Expanded Zone meets the requirements of Section 4(d) of the Act, namely (1) the boundaries of the Expanded Zone do not exceed the original size limitations and boundary requirements of the Act and do not exclude any part of the Zone as originally designated; (2) the Expanded Zone currently meets and will continue to meet all unemployment and economic distress criteria throughout the Expanded Zone as prescribed and required by Section 4(d)(2) of the Act; and (3) the City has not previously amended and expanded the boundaries of the Zone as originally designated. SECTION 3. Pursuant to the Act, the Expanded Zone is hereby nominated as an enterprise zone, subject to the approval of the Texas Department of Commerce in accordance with the Act. SECTION 4. The City will provide certain tax and other incentives applicable to business in the enterprise zone, the first four of which are not available throughout the City as follows: a. Public Works Improvements; b. Enterprise Zone Signage Program; c. Enterprise Zone Expeditor; d. Enhanced Police Services; e. City of Corpus Christi Tax Abatement as provided by the Guidelines and Criteria for Granting Tax Abatement; f. Tax Exempt Revenue Bonds; g. The Corpus Christi Foreign Trade Zone; h. Tax Increment Financing in the Reinvestment Zone #1, as established in Ordinance No. 19708; i. Federal Economic Development Administration (EDA) Public Works Grants; j. Corpus Christi Commercial Rehabilitation Loan Program; k. Housing and Urban Development 312 Rehabilitation Loan Program as federal funds become available; and 1. Minority Business Affirmative Action Program. SECTION 5. The City of Corpus Christi Office of the City Manager is hereby designated as the City's administrative agency to administer the Act within the Expanded Zone located wholly within the area of the corporate limits and the extraterritorial jurisdiction of the City. SECTION 6. The City Manager is hereby authorized and directed to submit an application to the Texas Department of Commerce for amendment and expansion of the boundaries of the Zone to include the Expansion Area, and for the designation of the Expanded Zone as a designated enterprise zone pursuant to the Act. The City Manager or his designee is further directed to act as a liaison to the Texas Department of Commerce. SECTION 7. The City authorizes the City Manager or his designee to sign and enter into an amended negotiated agreement with the Texas Department of Commerce, and to take all action necessary to accomplish the purposes of this ordinance. SECTION 8. All City Ordinances and Resolutions, and provisions of City Ordinances and Resolutions, in conflict herewith are hereby expressly repealed; provided, that if the application as described in Section 5 of this Ordinance is not approved by the Texas Department of Commerce, and thus the Expanded Zone is not designated as an enterprise zone by the Texas Department of Commerce pursuant to the Act, nothing herein, nor the refusal of the Texas Department of Commerce to designate the Expanded Zone as an enterprise zone, shall in any way whatsoever be construed to affect or nullify the original nomination and designation of the Zone as an enterprise zone as approved by the Texas Department of Commerce. SECTION 9. The provisions of this Ordinance are severable. If any section, subsection, paragraph, sentence, clause or phrase of this Ordinance is declared invalid by any court of competent jurisdiction, such declaration of invalidity shall not affect the remainder of this Ordinance which shall continue in effect. EXHIBIT A (Existing Enterprise Zone) An area approximately 6.74 square miles in the City of Corpus Christi consisting of all of census tracts 1, 2, 3, 4, 5, 6, 10, 11 and part of 7, and more particularly described as follows: Beginning at the intersection of Baldwin Blvd. and Agnes Street; Thence easterly along Agnes Street to its intersection with South Port Avenue; Thence southerly along South Port Avenue to its intersection with Morgan Avenue; Thence easterly along Morgan Avenue to its intersection with Brownlee Blvd; Thence northerly along Brownlee Blvd. to its intersection with the Tex Mex Railroad; Thence easterly along the Tex Mex Railroad to its intersection with South Staples Street; Thence southerly along South Staples Street to its intersection with Laredo Street; Thence easterly along Laredo Street to its intersection with South Tancahua Street; Thence northerly along South Tancahua to its intersection with Kinney Avenue; Thence easterly along Kinney Avenue to its intersection with South Upper Broadway; Thence southerly along South Upper Broadway to its intersection with Park Avenue; Thence easterly along Park Avenue to its intersection with Southbound S. Shoreline Blvd.; Thence southerly along S. Shoreline Blvd. to its intersection with Furman Avenue; Thence easterly along Furman Avenue to its intersection with S. Shoreline Blvd. north bound; Thence northerly along S. Shoreline Blvd. to intersection with the westerly extension of the north boundary line of McGee Beach; Thence easterly with said north line of McGee Beach to its intersection with the existing breakwater; Thence northerly along the contours of the existing breakwater to its northern most tip; Thence northwesterly with a line extended between the northern most tip of the existing breakwater and the existing barge dock, to a point, the southeast corner of said existing barge dock; Thence northwesterly along the east line of the existing barge dock and the meanders of the existing seawall (shoreline) to its intersection with the east R.O.W. line of the Harbor Bridge (U.S. Highway 181); Thence northerly with the east line U.S. Highway 181 to its intersection with the shoreline of the Corpus Christi Beach area; Thence in a general northeasterly direction along the meanders of said shoreline to its intersection with the south line of the Corpus Christi Beach breakwater; Thence in an easterly and northerly direction respectively with the meanders of the Corpus Christi Beach breakwater's edge, to its intersection along the east shoreline of the Corpus Christi Beach area; Thence in a general northerly and westerly direction respectively, along the meanders of said Corpus Christi Beach area shoreline, to its intersection with the northerly extension of the centerline of Ave. F, Brooklyn Add., the west boundary line of Census Tract 1; Thence in a southerly direction along said extension and the centerline of aforementioned Ave. F., past Breakwater Ave. to a corner in the present city limit line; Thence in a westerly direction along said present city limit line, to a corner in said line, the original northwest corner of the city limits of the City of Corpus Christi as it was first incorporated; Thence in a southerly direction continuing along said present city limit line to its intersection with Nueces Bay Blvd.; Thence southerly along Nueces Bay Blvd. to its intersection with Interstate 37; Thence westerly, leaving I-37 and continuing with the present city limit line to its intersection with Retama Avenue; Thence northerly along Retama Avenue to its intersection with Gibson Lane; Thence westerly along Gibson Lane to its intersection with Poth Lane; Thence southerly along Poth Lane to its intersection with the north boundary line of Country Club Place; Thence westerly along the north line of Country Club Place to its intersection with the west boundary line of Country Club Place; Thence southerly along the west line of Country Club Place to its intersection with I-37; Thence westerly along I-37 to its intersection with McBride Lane; Thence southerly along McBride Lane to its intersection with Leopard Street; Thence easterly along Leopard Street to its intersection with Omaha Drive; Thence southerly along Omaha Drive to its intersection with Baldwin Blvd., Thence southerly along Baldwin Blvd. to its intersection with Agnes Street for the point of beginning. BEGINNING at the intersection of the North boundary of Up River Road with the West boundary of Renfro Road at the Southwest corner of a 136.94 acre tract of land conveyed by Ester McGregor et al to Suntide Refining Co., by deed dated July 26, 1955, recorded in Volume 700, Page 346 of the Deed Records of Nueces County, Texas; THENCE along the North boundary of Up River Road North 66°26'40" West, 369.90 feet; North 65°01'15" West, 212.88 feet and North 63°16'30" West 224.60 feet to an intersection with the West right-of-way line of 60 foot wide Tecolote Road for the Southeast corner of a 3.18 acre tract owned by Nueces County and a corner of this tract; THENCE North 01°59'00" East, along the West boundary of Tecolote Road 503.33 feet to its Northwest corner at the Northeast corner of said 3.18 acre tract for an inside corner of this tract; THENCE North 81°17'10" West, 294.83 feet to the Northwest corner of said 3.18 acre tract for an inside corner of this tract; THENCE South 00°02'50" West, 434.69 feet to the Southwest corner of said 3.18 acre tract on the North boundary of Up River Road for a corner of this tract; THENCE North 72°40'50" West, along the North boundary of Up River Road 122.02 feet to an intersection with the East boundary of Hearns Ferry Road for the Southwest corner of a 23.804 acre tract formerly owned by Southern Mineral Corporation for a corner of this tract; THENCE along the Northeast boundary of said Hearns Ferry Road which is also the Southwest boundary of said 23.804 acre tract, North 22°23'00" West, 149.52 feet; North 36°37'00" West, 326.99 feet; North 40°32'00" West, 321.14 feet; North 64°00'00" West, 368.02 feet and North 31°41'40" West, 498.23 feet to the Northwest comer of said 23.804 acre tract for an inside corner of this tract; THENCE South 89°18'30" West, 34.98 feet to a point on the Northeast boundary of an 81.30 acre tract of land conveyed by Julius I. Blucher to C. D.
