AMENDING THE ZONING ORDINANCE UPON APPLICATION BY A & J
CONSTRUCTION COMPANY BY GRANTING A CHANGE OF ZONING
FROM "I-2" LIGHT INDUSTRIAL DISTRICT TO "FR" FARM -RURAL
DISTRICT AND BY GRANTING A SPECIAL COUNCIL PERMIT FOR A
FISH FARM SUBJECT TO SEVEN (7) CONDITIONS ON LOT 30 AND 10.76
ACRES OUT OF LOT 29, SECTION 52, FLOUR BLUFF & ENCINAL FARM
& GARDEN TRACTS; AND DECLARING AN EMERGENCY.
WHEREAS, the Planning Commission has forwarded to the City Council its
reports and recommendations concerning the application of A & J Construction Company to
the zoning map of the City of Corpus Christi.
WHEREAS, in accordance with proper notice to the public, a public hearing was
held on Tuesday, November 5, 1991, during a meeting of the City Council in the Council
Chambers at City Hall in the City of Corpus Christi allowing all interested persons to appear
and be heard; and
WHEREAS, the City Council has determined that the hereinafter set forth
amendment would best serve public health, necessity and convenience and the general welfare
of the City of Corpus Christi and its citizens:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF CORPUS CHRISTI, TEXAS:
SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is
amended by making the change hereinafter set out.
SECTION 2. That a Special Council Permit be granted on Lot 30 and 10.76 acres
out of Lot 29, Section 52, Flour Bluff & Encinal Farm & Garden Tracts, as more specifically
described in Exhibit "A" attached hereto, located at the terminus of Sweet Bay Drive,
approximately 1,260 feet south of Yorktown Boulevard, in accordance with the site plan
attached as Exhibit "B" and the following uses:
1. USE: The only use authorized by this Special Permit other than the basic "FR"
Farm -Rural District uses, is a fish farm.
2. SCREENING: In lieu of a screening fence, all ponds associated with the fish
farm facility shall be set back a minimum of fifty (50) feet from all property lines
that abut a residential district. Within the setback area, a minimum fifteen (15)
foot wide vegetation/brush area must be maintained.
3. PICK-UP AND DELIVERIES: All pick-up and deliveries must be in a vehicle not
to exceed a 3/4 ton weight and are limited to the hours between 7:00 am. and
3:00 p.m.

4. LIGHTING: All site and parking lot lighting must be shielded and directed
downward and away from the surrounding residential properties so as to reduce
glare.
5. SETBACK: All buildings must maintain a minimum setback of twenty (20) feet
from all property lines.
6. SIGNS: Outdoor advertising structures are prohibited.
7. SITE PLAN: All fish tanks shall be placed no closer to any property line than as
reflected on the attached site plan.
In the event the Board of Adjustment grants any special exception or variance to the
Zoning Ordinance, applicable to the Special Permit herein granted, other than the one specified
in this Special Permit, said Special Permit shall be void and of no force and effect whatsoever.
SECTION 3. That the official zoning map of the City of Corpus Christi, Texas,
be and the same is hereby amended as herein ordained.
SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi,
Texas, approved on the 27th day of August, 1973, as amended from time to time, except as
herein changed, shall remain in full force and effect.
SECTION 5. That all ordinances or parts of ordinances in conflict herewith are
hereby expressly repealed.
SECTION 6. That upon written request of the Mayor or five Council
members,copy attached, to find and declare an emergency due to the need for efficient
administration of City affairs by granting the aforesaid zoning change, such finding of an
emergency is made and declared requiring suspension of the Charter rule as to consideration
and voting upon ordinances at three regular meetings so that this ordinance is p,gssed and shall
take effect upon first reading as an emergency measure this the day of

Garden Tracts as shown on the map thereof recorded in Volume A, Page 41, of
the Map Records of Nueces County, Texas, said tract being more particularly
described by metes and bounds as follows:
COMMENCING at a 1 1/2 inch pipe found for the common northerly corner of Lot
29 and Lot 30, Section 52, also being the southwest corner of Bayside Acres,
a subdivision recorded in Volume 15, Page 31, of the Map Records of Nueces
County, Texas;
THENCE with the common boundary of Lot 29 and Lot 30 South 29° West following
a fenceline 660.0 feet to a 5/8 inch iron rod set for the northwest corner
and POINT OF BEGINNING of,,the tract herein described;
THENCE South 61° East, at 305.0 feet pass a 5/8 inch rod, at 355.0 feet Lass
a 5/8 inch iron rod, in all 660.0 feet to a 5/8 inch iron rod set on a fence -
line and the east boundary of Lot 29 for the northeast corner of this tract;
THENCE :.,uth 29° West following a fenceline 660.0 feet to a 1 1/2 inch pipe
found for the southeast corner of Lot 29 and the southeast corner of this tract;
THENCE North 61° West 660.0 feet -following and approximately 13 feet north of
the Central Power and Light Company fence to a 1 1/2 inch iron pipe found for
the common southerly corner of Lot 29 and Lot 30, Section 52, for the southwest
corner of this tract;
THENCE with the common boundary of said Lot 29 and Lot 30 and following an old
fenceline North 29° East 660.0 feet to a 5/8 inch iron rod for the northwest
corner and POINT OF BEGINNING, containing in all 10.00 acres, more or less.

For the reasons set forth in the emergency clause of the foregoing ordinance an emergency
exists requiring suspension of the Charter rule as to consideration and voting upon ordinances at
three regular meetings; I/we, therefore, request that you suspend said Charter rule and pass this
ordinance finally on the date it is introduced, or at the present meeting of the City Council.
