HomeMy WebLinkAbout021288 ORD - 11/19/1991AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION BY ENRIQUE M. VASQUEZ JR. BY GRANTING A CHANGE OF ZONING FROM "A-1" APARTMENT HOUSE DISTRICT TO "AB" PROFESSIONAL OFFICE DISTRICT AND BY GRANTING A SPECIAL COUNCIL PERMIT FOR THE RETAIL SALE OF HAIR CARE PRODUCTS SUBJECT TO TWO (2) CONDITIONS ON LOT 44, BLOCK 3, SOUTH PARK ADDITION; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Enrique M. Vasquez Jr. for amendment to the zoning map of the City of Corpus Christi; WHEREAS, in accordance with proper notice to the public, a public hearing was held on Tuesday, November 19, 1991, during a meeting of the City Council in the Council Chambers at City Hall in the City of Corpus Christi allowing all interested persons to appear and be heard; and WHEREAS, the City Council has determined that the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That the zoning on Lot 44, Block 3, South Park Addition, located on the north corner of Concord Street and South Padre Island Drive, be changed from "A-1" Apartment House District to "AB" Professional Office District and that a Special Council Permit be granted on same, in accordance with the following site plan and uses: 1. USE: The only use authorized by this Special Permit other than the basic "A -B" Professional Office District uses, is the retail sale of hair care products as an incidental use to the main use as a hair stylist shop. 2. ACCESS: Vehicular access is limited to South Padre Island Drive frontage road. Vehicular access to Concord Street is prohibited. In the event the Board of Adjustment grants any special exception or variance to the Zoning Ordinance, applicable to the Special Permit herein granted, other than the one specified in this Special Permit, said Special Permit shall be void and of no force and effect whatsoever. RP1840.035.kp 021283 SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members,copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at three regular meetings so that this ordinance is assed and shall t k_ e effect upon first reading as an emergency measure this the r day of IL( /If LC_ ' , 1991.
