HomeMy WebLinkAbout021297 ORD - 12/03/1991AN ORDINANCE AMENDING THE CODE OF ORDINANCES, CHAPTER 23, HEALTH AND SANITATION, SECTIONS 23-70, PROCEDURES AS TO REMOVAL OF CARRION, FILTH, ETC.; 23-71 PROCEDURE AS TO CUTTING OR REMOVAL OF WEEDS, RUBBISH, BRUSH, ETC; AND PROVIDING FOR POSTING IN LIEU OF PUBLICATION NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Corpus Christi Code of Ordinances, Chapter 23, Health and Sanitation, Section 23-70, Procedures as to removal of carrion. filth. etc., is hereby amended to read: Sec. 23-70. Procedure as to removal of carrion, filth, etc. Should the owner of any premises or building within the city upon which carrion, filth or other impure or unwholesome matter may be, fail or refuse to remove such filth, carrion or other impure or unwholesome matter within ten (10) days after personal notice to such owner to do so in writing or by letter addressed to the owner at the owner's post -office address, or if personal service cannot be obtained or if the owner's post office address is unknown, within ten (10) days after notice by publication as many as two (2) times within ten (10) consecutive days in any newspaper in the city, or within ten (10) days after notice by posting the notice on or near the front door of each building on the property to which the violation relates, or if the property contains no buildings, by posting the notice on a placard attached to a stake driven into the ground on the property to which the violation relates, the city may then do such removal of filth, carrion, etc., or any other unsightly, objectionable or insanitary matter, or cause the same to be done and may pay therefore and charge the expenses incurred, in doing such work or having such work done or improvements made, to the owner of such lot or real estate. If the work is done or improvements made at the expense of the city, then expense for the work or improvements shall be assessed on the real estate or lot upon which such expense was incurred. (Code 1958, § 19-35) SECTION 2. That the Code of Ordinances, Chapter 23, Health and Sanitation, Section 23-71, Procedure as to cutting or removal of weeds. rubbish. brush. etc. is hereby amended to read: Sec. 23-71. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 4. Publication shall be made in the official publication of the City of Corpus Christi as required by the City Charter of the City of Corpus Christi.
