HomeMy WebLinkAbout021307 ORD - 12/17/1991AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF ROBERT HARRIS BY GRANTING A SPECIAL COUNCIL PERMIT FOR A PARKING LOT SUBJECT TO A SITE PLAN AND FIVE (5) CONDITIONS ON LOT 3, BLOCK 8, GARDENDALE NO. 2; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Robert Harris for amendment to the zoning map of the City of Corpus Christi; WHEREAS, in accordance with proper notice to the public, a public hearing was held on Tuesday, December 3, 1991, during a meeting of the City Council in the Council Chambers at City Hall in the City of Corpus Christi allowing all interested persons to appear and be heard; and WHEREAS, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That a Special Council Permit be granted on Lot 3, Block 8, Gardendale No. 2, located on the south side of Curtis Clark Drive approximately 166 feet east of Everhart Road, situated in the City of Corpus Christi, Nueces County, Texas, according to the site plan, a copy of which is attached hereto and made a part hereof, marked Exhibit "A," and subject to five (5) conditions as follows: RP1840.045.kp 1 021307 fteoatesED 1. USES: The only use authorized by this Special Permit other than the basic "R -1B" One -Family Dwelling District uses is a parking lot to serve the adjacent land fronting Everhart Road. 2. SETBACK: A 25 foot front building and parking setback shall be maintained, except that only one (1) driveway may be permitted within the setback area. 3. LANDSCAPING: The property must comply with the landscaping requirements set forth in Article 27B, "Landscape Requirements." For the purposes of the landscaping requirements, the 25 foot front setback must be landscaped, excluding the driveway, and must contain at least one (1) evergreen tree with a minimum caliper of three (3") inches. 4. SCREENING: A six (6') foot tall screening fence shall be maintained along the north and east boundary lines. The height of the screening fence within the 25 foot front setback shall not exceed four (4') feet. For a distance not to exceed four (4') feet behind the front setback, the fence may be transitioned from the four (4') foot height to the six (6') foot height. 5. LIGHTING: All lighting on the property must be shielded and directional lighting and shall be directed away from the single- family residential area. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an RP1840.045.kp 2 emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at three regular meetings so that this ordinance is passe and shall take effect upon first reading as an emergency measure this the / r day of tjQ C.1' r , 1991.
