HomeMy WebLinkAbout021314 ORD - 12/31/1991AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF ZELDA B. CLARY BY GRANTING A SPECIAL COUNCIL PERMIT FOR A LAWN CARE SERVICE SUBJECT TO A SITE PLAN AND EIGHT (8) CONDITIONS ON LOT 1, BLOCK 8, WOODLAWN ESTATES; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Zelda B. Clary for amendment to the zoning map of the City of Corpus Christi; WHEREAS, in accordance with proper notice to the public, a public hearing was held on Tuesday, November 19, 1991, during a meeting of the City Council in the Council Chambers at City Hall in the City of Corpus Christi allowing all interested persons to appear and be heard; and WHEREAS, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That a Special Council Permit be granted on Lot 1, Block 8, Woodlawn Estates, located on the northeast corner of Daly and William Drives, situated in the City of Corpus Christi, Nueces County, Texas, for a lawn care service, according to the site plan, a copy of which is attached hereto and made a part hereof, marked Exhibit "A," and subject to eight (8) conditions as follows: 1. USES: The only use authorized by this Special Permit other than the basic "R -1B" One -Family Dwelling District uses is a landscaping service incidental to the main use as a dwelling. Sales and display of merchandise is prohibited. 't1 tOHLMED RP1840.043.kp 1 021314 2. EMPLOYEES: A maximum of one (1) employee in addition to resident -family members reporting on-site. 3. VEHICLES AND ROLLING STOCK: A maximum of one (1) truck and one (1) trailer associated with the lawn care service may be stored/parked on the premises at any given time, provided they are located inside the screening fence at all times. 4. OUTSIDE STORAGE: No outside storage permitted on premises. Storage of all items, equipment, hand and power tools, motorized and non -motorized lawn care equipment, supplies, and parts or components associated with the lawn care service business shall be stored within the designated accessory storage structure as per the site plan. No lawn care/construction debris may be brought onto or stored upon premises. 5. SCREENING FENCE: Six (6') foot tall screening fence shall be maintained along the rear and side lot lines of the area used for the lawn care business. 6. ACCESS: Only from Williams Drive for landscaping service activities. 7. SIGNS: Limited to maximum of one (1) wall sign not to exceed one (1) square foot. 8. HAZARDOUS OR OBNOXIOUS MATERIALS STORAGE OR USE: A maximum total of 25 gallons of pesticide, insecticide or similar liquids may be stored on premises in containers no larger than 5 gallons each. A maximum total of 250 pounds of fertilizer, top soil, sand, manure, etc. may be stored on premises. Repair/welding of lawn care equipment must be conducted inside storage building. No delivery of materials to site. In the event the Board of Adjustment grants any special exception or variance to the Zoning Ordinance, applicable to the Special Permit herein granted, other than the one specified in this Special Permit, said Special Permit shall be void and of no force and effect whatsoever. RP1840.043.kp 2 SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 3 1 day of l( nv(y t ,X9'91.
