PROHIBITING CERTAIN SIGNS ADVERTISING ALCOHOL
AND TOBACCO WITHIN 500 FEET OF ELEMENTARY AND
SECONDARY SCHOOLS; PROVIDING FOR SEVERABILITY;
PROVIDING FOR PUBLICATION; AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, advertising of alcohol and tobacco near elementary and secondary
schools encourages impressionable young students to partake of such products; and
WHEREAS, the use of alcohol and tobacco by young students poses a threat to their
physical and emotional well-being; and
WHEREAS, it is reasonable and necessary to the public health, safety, and welfare
to prohibit certain prominent signs advertising alcohol and tobacco within 500 feet of
elementary and secondary schools.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
Section 1. That the Corpus Christi Code of Ordinances, Chapter 23, Health and
Sanitation, Article I, In General, be amended by adding a new Section 23-21, Regulation
of Alcohol and Tobacco Advertising Near Schools, to read as follows.
a. Definitions. In this section:
.(1l The term "billboard" means a sign supported by a structure or
structures extending from the ground and not attached to a
building which is used to advertise an establishment, product
goods, or services when placed out of doors in view of the
general public.
Q) The term "electric sign" means a structure or device by which
artificial light produced by electricity is used to advertise an
establishment. product. goods, or services when placed out of
doors in view of the general public.
D. The term "school" means a public or private elementary or
secondary school.

b. Offenses.
No person shall erect or maintain a billboard or electric sign
which advertises an alcoholic beverage or product within 500
feet of a school.
Q2) No person shall erect or maintain a billboard or electric sign
which advertises tobacco or a tobacco product within 500 feet
of a school,
c. The measurement of the distance between a billboard or electric sign
and a school shall be from the nearest property line of the school to
the nearest portion of the billboard or electric sign. along street lines
and in a direct line across intersections where they occur.
Section 2. If for any reason any section. paragraph. subdivision. clause phrase word
or provision of this ordinance shall be held invalid or unconstitutional by final judgment of
a court of competent jurisdiction. it shall not affect any other section. paragraph. subdivision
clause. phrase. word or provision of this ordinance for it is the definite intent of this City
Council that every section. paragraph. subdivision. clause. phrase. word or provision hereof
be given full force and effect for its purpose.
Section 3. Publication shall be made in the official publication of the City of Corpus
Christi as required by the City Charter of the City of Corpus Christi.
Section 4. This Ordinance shall take effect 90 days after publication.
