HomeMy WebLinkAbout021364 ORD - 04/07/1992AN ORDINANCE CLOSING AND ABANDONING A 10 -FOOT WIDE BY 314.01 -FOOT LONG UTILITY EASEMENT BETWEEN LOT 2, BLOCK 4 AND LOT 14, BLOCK 3, MOORE PLAZA, WHICH IS RECORDED IN VOLUME 54, PAGES 80-81, OF THE MAP RECORDS OF NUECES COUNTY, TEXAS; MEETING SPECIFIED REQUIREMENTS, AND REPLATTING THE PROPERTY WITHIN 180 DAYS; AND DECLARING AN EMERGENCY. WHEREAS, Applicant wishes to expand across a 10 -foot wide by 314.01 -foot long utility easement between Lot 2, Block 4 and Lot 14, Block 3, Moore Plaza, shown by plat in Volume 54, Pages 80-81, Map Records, Nueces County, Texas; and WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said easement, subject to the provisions listed below. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI: SECTION 1. That a 10 -foot wide by 314.01 utility easement between Lot 2, Block 4 and Lot 14, Block 3, Moore Plaza, which is recorded in Volume 54, Pages 80-81 of the Map Records of Nueces County Texas; subject to the applicant meeting the following conditions: 1. Dedication of new easement to replace the one being closed. 2. The abandoned 8 -inch water line and fire hydrant be replaced in new easement and looped into existing system at applicant's expense. 3. Plans for water line construction be approved by City Engineer. 4. New water line construction must be accepted by the Water Division prior to abandonment of existing water line. 5. All work to be done under the inspection of a Water Division Inspector. 6. As -built drawings, reflecting any changes not shown on construction drawings, must be submitted to Engineering and Water Departments upon completion of project. AG5000.109.aar 021364 MAIMED 7. Paying for relocation of CP&L lines into new easement. Estimated cost of relocation is $8,500. Applicant is also required to provide and install two 4" PVC ducts 48" deep with 48" radius with 90 degree elbows and one 5' x 6' concrete splice box. 8. Replatting of the property within 180 days, provided, however, the City Engineer may extend the time limit for an additional one hundred eighty (180) days if extenuating circumstances outside the applicant's control necessitate an extension. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 1 day of yt t , 1992.
