HomeMy WebLinkAbout021369 ORD - 04/07/1992AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF NUECES COUNTY BY GRANTING A SPECIAL COUNCIL PERMIT FOR A COUNTY JAIL FACILITIES ON LOT 1, BLOCK 15, AIRPORT INDUSTRIAL PARK, SUBJECT TO TWO CONDITIONS; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Nueces County for amendment to the zoning map of the City of Corpus Christi; WHEREAS, in accordance with proper notice to the public, a public hearing was held on Tuesday, April 7, 1992, during a meeting of the City Council in the Council Chambers at City Hall in the City of Corpus Christi allowing all interested persons to appear and be heard; and WHEREAS, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That a Special Council Permit be granted on Lot 1, Block 15, Airport Industrial Park, located on the west side of North Padre Island Drive, approximately 1,090 feet south of State Highway 44, situated in the City of Corpus Christi, Nueces County, Texas, for a county jail facilities, in accordance with the following site plan: 1. IJSE: The only use authorized by this Special Permit, other than the basic "I-2" Light Industrial District uses, is a county jail facility with lodging facilities and other accessory uses. 2. SETBACK: Any new construction or expansion may not extend beyond the existing front yard fence line parallel to North Padre Island Drive. A fifty (50') foot building setback shall be maintained from residentially -zoned properties. In the event the Board of Adjustment grants any special exception or variance to the Zoning Ordinance, applicable to the Special Permit herein granted, other than the RP1840.062.kp imiteEINED 021369 one specified in this Special Permit, said Special Permit shall be void and of no force and effect whatsoever. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at three regular meetings so that this ordinance is passed nd shall ake effect upon first reading as an emergency measure this the —T day of , 1992.
