HomeMy WebLinkAbout021375 ORD - 04/21/1992A RESOLUTION ENDORSING LEGISLATION BY STATE REPRESENTATIVE EDDIE CAVAZOS TO STRENGTHEN LAWS REGULATING ABUSABLE GLUE AND AEROSOL PAINT WHEREAS, abuse of glue and aerosol paint by young people presents a serious threat to mental and physical health in this community and throughout the State; and WHEREAS, State Representative Eddie Cavazos has announced plans to strengthen state legislation regarding abusable glue and aerosol paint; and WHEREAS, Representative Cavazos' legislation would: (1) delete the statutory provision prohibiting City ordinances enacted after September 1, 1989 from requiring that displays of abusable glue and aerosol paint be displayed in a manner inaccessible to patrons without assistance; (2) authorize such ordinances enacted before September 1, 1989 to remain in effect; (3) require purchasers of inhalant paraphernalia in quantities of 3 or more to show proof of age and sign an affidavit attesting to its intended lawful use, (4) increase the penalty under Section 485.034(b) of the Texas Health and Safety Code for delivering or possessing with intent to sell inhalant paraphernalia from a Class A misdemeanor to a felony, and (5) increase the lawful age to purchase inhalant paraphernalia from 18 to 21 years of age; and WHEREAS, such changes would contribute to reduction in the problems of inhalant abuse. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City of Corpus Christi supports Representative Eddie Cavazos' legislation and efforts to strengthen laws governing abusable glue and aerosol paint. SECTION 2.
