HomeMy WebLinkAbout021385 ORD - 05/05/1992AN ORDINANCE AMENDING THE CODE OF ORDINANCES, CHAPTER 9, AVIATION, SECTION 9-61, AND CHAPTER 57, VEHICLES FOR HIRE, SECTION 150, REGULATING THE AIRPORT SHUTTLE SERVICES; PROVIDING FOR SEVERABILITY; REPEALING CONFLICTING ORDINANCES; AND DELETING AND RESERVING SECTIONS 57-151 THROUGH 57-163; AND PROVIDING FOR PUBLICATION. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Code of Ordinances, Chapter 9, Aviation, Section 9-61, is hereby amended to include shuttle service as follows: Sec. 9-61. Permit for commercial ground transportation operations. a'. It is unlawful for any person to charge, operate, or drive, for hire or other consideration any vehicle to carry, deliver, pick up any cargo, passenger, freight, or mail at the Corpus Christi International Airport without a valid permit issued by the airport for commercial ground transportation operations ("ground transportation permit"). Each applicant for a ground transportation permit shall register with the airport manager and comply with all rules and regulations set by the City of Corpus Christi. Except for the airport shuttle and limousine service, each person operating a ground transportation service at the airport shall pay permit fees as set forth in the following schedule: (3) Taxicabs, six hundred dollars ($600.00) per vehicle per year (may be payable in installments). Cargo/package pickup/delivery service, one hundred dollars ($100) per month for up to five (5) vehicles and twenty-five dollars ($25) per month for each additional vehicle. Courtesy vehicles for rental car customers, one hundred dollars ($100) per month for up to three (3) vehicles and twenty-five dollars ($25) per month for each additional vehicle. (4) Courtesy dollars vehicles for each vehicles for hotel/motel customers, fifty ($50) per month for up to three (3) and twenty-five dollars ($25) per month additional vehicle. AG0100.005E.kp 1 021385 MICROFILMEC (5) Courtesy vehicles for off -airport parking lot operators, two hundred dollars ($200) per month for up to three (3) vehicles and twenty-five dollars ($25) per month for each additional vehicle plus a variable amount equal to ten dollars ($10) per month per parking space for the highest number of parking spaces dedicated at one time during the previous month for use by customers utilizing the airport. Q The directorof aviation or .uccessor official shall issue ground transportation permits, enforce all rules and regulations with respect to ground transportation services, and collect applicable permit fees. Should any permit holder fail to comply with applicable rules, regulations, and ordinances, such permit holder shall be issued a notice of noncompliance. Should the violation persist for ten (10) days after the issuance of said notice, such permit holder may be prohibited from conducting further operations on airport property. SECTION 2. That the Code of Ordinances, Chapter 57, Vehicles for hire, Sections 150-163, is hereby amended as follows: ARTICLE III. AIRPORT SHUTTLE AND LIMOUSINE SERVICE Sec. 57-150. Franchise required. It shall be unlawful for any person to drive or operate or cause to be driven or operated upon or over the streets and public thoroughfares of the city any vehicle other than duly licensed and franchised taxicabs with pickup and delivery of passengers to and from the Corpus Christi International Airport without having applied for and obtained a franchise from the city council authorizing such operation in compliance with the regulations provided by ordinance pertaining to such airport shuttle and limousine operation and in compliance with the provisions of any such franchise. Sec. 57-151 through Sec. 57-163. Reserved. SECTION 3. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. Publication shall be made one time in the official publication of the City of Corpus Christi by publishing the caption stating in substance the purpose of the ordinance, this ordinance to become effective upon such publication. SECTION 5. All ordinances in conflict with this ordinance shall be repealed.
