HomeMy WebLinkAbout021433 ORD - 07/14/1992AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF YUNBAE CHOE BY GRANTING A SPECIAL COUNCIL PERMIT FOR A SERVICE STATION ON BLOCK B, CASA LINDA ESTATES UNIT 4; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Yunbae Choe for amendment to the zoning map of the City of Corpus Christi. WHEREAS, in accordance with proper notice to the public, a public hearing was held on Tuesday, July 14, 1992, during a meeting of the City Council in the Council Chambers at City Hall in the City of Corpus Christi allowing all interested persons to appear and be heard; and WHEREAS, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That a Special Council Permit be granted on Block B, Casa Linda Estates Unit 4, situated in the City of Corpus Christi, Nueces County, Texas, located on the south corner of S. Staples Street and Kostoryz Road for a service station, subject to the following site plan and subject to all other considerations of "B-1" Neighborhood Business District: 1. USE: The only use authorized by this Special Permit other than the basic "B -I" Neighborhood Business District uses is a service station. 2. BAYS: The service station may have a maximum of three (3) auto service bays. 3. SETBACK: Development on the property must maintain a ten (10) foot minimum building setback from the southwest property line. 4. SCREENING: A standard screening fence at least six (6) feet in height from the natural ground, which constitutes a visual obstruction, and which is capable of \RP\RPS000.001 1 021433 MiCk0FILME0 withstanding a thirty (30) pound per square foot horizontal wind load from any direction must be provided and maintained along the southwest property line. In the event the Board of Adjustment grants any special exception or variance to the Zoning Ordinance, applicable to the Special Permit herein granted, other than the one specified in this Special Permit, said Special Permit shall be void and of no force and effect whatsoever. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at three regular meetings so that this ordinaqce is passed and shall take effect upon first reading as an emergency measure this the f day of (, 1919 X AI'1EST: City Secretary \C.
