HomeMy WebLinkAbout021437 ORD - 07/21/1992AN ORDINANCE AMENDING ORDINANCE 3658, SECTIONS AND SUBSECTIONS 101, 102, 152.1, 201.1, 201.2, BY REVISING LANGUAGE TO BE IN COMPLIANCE WITH THE AMERICANS' WITH DISABILITTFS ACT AND REVISING CLASSIFICATION SCHEDULES IN SECTIONS 251 THROUGH 257. AMENDING ORDINANCE 8127, SECTION 510, MANAGERIAL PAY PLAN, 1991-92, BY REPLACING IT WITH A REVISED SALARY RANGE AND CLASSIFICATION SCHEDULE. AMENDING ORDINANCE 8127, SECTION 950, LEAVES OF ABSENCE, SUJBSECTION 951.4, BY CLARIFYING ANNUAL CARRY OVER PROVISIONS OF VACATION ACCRUAL FOR PLAN IEMPLOYEES; AMENDING ORDINANCE 8127 BY REVISING THE LANGUAGE OF SUBSECTION 953.3 DISABILITY LEAVE, TO BE IN COMPLIANCE WITH THE AMERICANS" WITH DISABILITIES ACT. PROVIDING FOR SEVERANCE; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Ordinance 3658, as amended, Section 101, Classification of Positions, be amended to read as follows: 101 A11 positions in the classified service shall be grouped into classes and each class shall include those positions suffi- ciently similar in respect to their essential functions a1iiiieA and responsibilities so that similar requirements as to train- ing, experience, knowledge, skill, personal qualities and the same rates of compensation are applicable thereto. SECTION 2. That Ordinance 3658, as amended, Section 102, Preparation of Content of Class Specifications, be amended to read as follaas: 102 Class specifications shall be prepared by the Civil Service Director and reviewed with the City Manager or his designated representative Abil/A¢/StAtAAVelyl, W10Msin/Nei siil*/ d, before advertising or interviewing to fill Classifications. Class specifications shall dttiatO define the essential functions gUit404 of all positions and the minimum entrance qualifications for successful performance of such essential functions g1iit.itA. In addition to the specific qualifications as set forth in the class specifications, it shall be understood that all positions require: ability to read, write, speak, and understand the English language and to follow written and oral instructions; ability to get along with others; throughness, accuracy, sobriety, integrity, loyalty, and a record of orderly law-abiding citizenship. SECTION 3. That Ordinance 3658, as amended, Section 152, Interpretation of Class Specifications, Subsection 152.1, be amended to read as follows: 152.1 Purpose and Effect of Class Specifications: Each class speci- fication outlines the;Mill essential functions, characteristics and qualification requirements Of for each positionA in the class and describes essential functions ¢It7514/Mata(d01451//df 400t4tit/dAL4A which an employeeA holding that specific 4i40M positionA may properly be required to perform. SECTION 4. That Ordinance 3658, as amended, Section 200, Administration and Maintenance of the Classification Plan, Sections 201.1 and 201.2, be amended to read as follows: 201.1 The Civil Service Director shall be responsible for administer- ing and maintaining the Classification Plan. As directed by the Civil Service Board, the Director shall make necessary reviews and prepare reports recommending appropriate actions to assure that the classification plan is kept current and that any important changes in essential functions Rlilifi¢fi and respon- sibilities in any existing position and of new positions are reflected in the classification plan. 201.2 The Civil Service Director after consultation with the City Manager, or his designated representative, and the department officials concerned, g►i$.XX/ /fbt/Mid/¢¢t,i954/hV/hi¢ OL*12/44444441Akkoq, shall implement the reallocation of any position from one class to another class whenever a change in essential functions fiti¢t and responsibilities of such posi- tion make the class to which the position was previously allocated no longer applicable. Any proposed reallocation shall be made with the knowledge of the employee concerned. SECTION 5. That Ordinance No. 3658, as amended, be amended by amending Sections 251, 252, 253, 254, 255, 256, and 257 to read as shown in Exhibit A, (2) Ordinance No. 8127, as amended be amended by amending Section 510, to read as shown in Exhibit B, and (3) Ordinance No. 8127, as amended, be amended further effective January 11, 1993, to read as shown in Exhibit C. SECTION 6. That Ordinance 8127, as amended, Section 950, Leaves of Ab- sence, Subsection 951.4, Accumulation of Vacation Leave, be amended to read as follows: 951.4 (a) Accumulation and Carryover of Vacation Leave. Vacation leave credit may be accumulated by Plan I Employees to a maximum of 240 hours plus their current annual accrual rate during the calendar year. Vacation Accrual which exceeds 240 hours as of the last payperiod of the calendar year will be deleted if not used prior to that date. The City manager may authorize exceptions based on extraordinary circumstance, work requirements or for other purposes deemed beneficial to the City Service. 951.4 (b) Payment of Accrued Vacation Leave Upon Termination, Retire- ment, or Death. No more than 240 hours of accumulated vacation credit will be paid to a Plan I Employee or his/her beneficiary upon termination, retirement, or death. No vacation credit shall be paid at termination unless the employee has been employed for period of time in excess of twelve (12) months. SECTION 7. That Ordinance 8127, as amended, Section 953.0, Disability save, Subsection 953.3, be revised to read as follows: 953.3 A11 employees, other than those included in the Fire and Police collective bargaining units, who are unable to perform the essential functions 0U//f 2/I//iqSjb//5jtr/i,E4 of their specific position, with reasonable accommodations and without an =medi- ate direct threat of significant risk of harm to self and/or others, as the result of any injury or illness, whether job-related or not, shall be subject to the terms and pro- visions of the City's Official Policy regarding Employee Disability, as such Policy may be amended frau time to time. Such Policy, as it may be amended from time to time, is incor- porated herein by reference to the same extent as if such Policy were set out in full in this Section. SECTION 8. If, for any reason, any section, paragraph, sub -division, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, sub -division, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, sub -division, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 9. That upon written request of the Mayor or five Council members, copy attached, to find and declare an urgency due to the need for the effi- cient and effective administration of City affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consid- eration and voting upon ordinances at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure.
