AMENDING THE CITY CODE, CHAPTER 55, UTILITIES,
ARTICLE III, WATER RATES AND CHARGES, SECTION
55-50, SCHEDULE, BY AMENDING THE WATER RATE
SCHEDULE FOR CUSTOMERS USING TREATED AND
UNTREATED WATER; PROVIDING FOR SEVERANCE; AND
PROVIDING FOR PUBLICATION.
WHEREAS, On February 12, 1991, the City Council adopted Ordinance
No. 21078 that partially repealed water rate schedule as adopted on
October 9, 1990, Ordinance No. 21001; and
WHEREAS, the City Council has determined that Ordinance No. 21078
should be repealed, and that Section 55-50 should be amended;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That Ordinance No. 21078 is hereby repealed to the
extent of the amendments provided herein.
SECTION 2. That City Code, Chapter 55, Utilities, Article III,
Water Rates and Charges, Section 55-50, Schedule, is hereby amended to
hereafter provide as follows:

SECTION 3. That City Code, Chapter 55, Utilities, Article III,
Water Rates and Charges, Section 55-50, Schedule, is hereby amended by
changing the Public Agency for Resale Rates, to read as follows:

SECTION 4. That City Code, Chapter 55, Utilities, Article III,
Water Rates and Charges, Section 55-50, Schedule, is hereby amended by
increasing the price of untreated water to industrial, municipal and
domestic users to be included in said section, reading as follows:

All untreated water sold and delivered at any point of delivery where
such water is available directly to the consumer, shall be at the
following rates:

In instances where the City of Corpus Christi has entered into
development of alternative water supplies, a supplemental charge will be
added to the basic cost of untreated water. This supplemental charge
will be calculated by dividing the total actual monthly expenditures for
well drilling (amortized over four years), pumping, and land leases,
plus other water supply development costs, by the actual water withdrawn
for the month to provide a cost per 1,000 gallons to be billed to each
raw water customer according to their use.
SECTION 5 That all ordinances and parts of ordinances in conflict
herewith be and the same are hereby repealed to the extent to such
conflict.
SECTION 6. If for any reason any section, paragraph, subdivision,
clause, phrase, word or provision of this ordinance shall be held
invalid or unconstitutional by final judgment of a court of competent
jurisdiction, it shall not affect any other section, paragraph,
subdivision, clause, phrase, word or provision of this ordinance for it
is the definite intent of this City Council that every section,
paragraph, subdivision, clause, phrase, word or provision hereof be
given full force and effect for its purpose.
SECTION 7. The rates established in this ordinance shall be
applied against all water service provided on or after July 30, 1992.
SECTION 8. Publication shall be made one time in the official
publication of the City of Corpus Christi by publishing the caption
stating in substance the purpose of the ordinance.

SUBJECT: Administrative Correction of Scrivener's Errors In Ordinance 21438 Amending
the City Code, Chapter 55, Utilities, Article III, Water Rates and Charges,
Section 55-50, Schedule, Sections 2 and 3.
REQUEST:
That the City Secretary make administrative corrections to Ordinance No. 21438.
That subject ordinance, Exhibit A, contains scrivener's or typographical errors
appropriate for administrative correction. The errors consist of incorrect numerical values
assigned to represent what the council intended to be a 6% rate increase for water.
The errors consist of 1) a mere transposition of numbers in a single case, and 2) a
12% rather than 6% increase for a class of purchasers under Public Agency Resale.
BACKGROUND:
The Ordinance to be corrected was passed first reading June 23, 1992, as evidenced
by Exhibit B, Minutes of Special Council Meeting, in which "Mr. Martin amended his earlier
motion to include six percent [emphasis supplied] for Gas and Water [emphasis supplied]
and four percent for Wastewater with all the other provisions ...."
Exhibit C evidences passage on the second reading, June 30, 1992.
Exhibit D evidences passage on the third reading, July 31, 1992.

1) Correction of the transposition error may be accomplished with the following
change on page 2 of the ordinance:
