HomeMy WebLinkAbout021440 ORD - 07/21/1992AN ORDINANCE AMENDING SECTION 55-100 OF THE CODE OF ORDINANCES, CITY OF CORPUS CHRISTI TO PROVIDE CERTAIN INCREASES IN WASTEWATER RATES; DELETING RATES FOR DRIED SLUDGE; ADOPTING A WINTER AVERAGING RATE DESIGN SYSTEM FOR ONE FAMILY RESIDENCES EFFECTIVE JUNE 1, 1993; PROVIDING FOR REPEAL OF ALL ORDINANCES IN CONFLICT; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE; AND PROVIDING FOR PUBLICATION NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Article VII, Section 55-100 of the Code of Ordinances, City of Corpus Christi, be and the same is hereby amended to hereafter read as follows: Class Sec. 55-100. Schedule of Wastewater Rates. A. The monthly charge to be paid by users of sewer service furnished by the city's municipal sewer system, except as provided in sections 55-101 and 55- 140 through 55-146 shall be based on the amount of water used by such users inside the city limits and outside the city limits according to the following schedule of rates based on water consumption: SCHEDULE OF RATES BASED UPON WATER CONSUMPTION FOR WASTEWATER SERVICE CUSTOMERS WITH WASTEWATER CHARACTERISTICS OF 250 PARTS PER MILLION OR LESS OF BIOCHEMICAL OXYGEN DEMAND, AND 250 PARTS PER MILLION OR LESS OF SUSPENDED SOLIDS. Inside City Limits One family minimum $7.779 For first 2,000 Gal One family maximum $31.49 Up to 21,000 Gal Outside City Limits $15.558 For first 2,000 Gal $62.98 Up to 21, 000 Gal MICROFILMED ORD4: 91154 1 021440 Commercial minimum $12.074 $24.148 For first 2,000 Gal For first 2,000 Gal The charges in addition to the above minimums, as well as the charge for all other wastewater users, will be computed as dollars per one thousand (1,000) gallons of water used as follows: Dollars per 1,000 Gallons of Water Used Inside City Limits One family residential (per 1,000 Gallons of Water) Commercial (per 1,000 Gallons of Water) Outside City Limits One family residential (per 1,000 Gallons of Water) Commercial (per 1,000 Gallons of Water) $ 1.248 $ 1.289 $ 2.496 $ 2.579 B. Effective June 1, 1993, usage on monthly bills to one family residential customers shall be computed on the basis of the "winter average" or the "interim average" as set forth below. Methods of Calculating Winter Average Billing for One -Family Residential Customers. (1) Definitions (a) Winter Averaging Wastewater Charge Period - the period of water and wastewater service during the three complete consecutive reading periods commencing on or after November 15 of each year. During the three complete consecutive reading periods, the City shall establish monthly wastewater service charges for customers based upon their average monthly water consumption. The customer must receive wastewater service at one location during the three consecutive reading periods in order to establish a "winter average". (b) Winter Average - The monthly wastewater usage established by the City of Corpus Christi during the "winter averaging wastewater charge period". This usage is the basis for monthly billings until June 1 of each year. Billings on or oRD4: 91154 2 after June 1 will reflect wastewater usage based on the previous "winter averaging wastewater charge period." (c) Interim Average - The monthly wastewater usage established by the City for customers who have not established a "winter average". The "interim average" shall be 7,000 gallons per month and shall be the basis for monthly billings until a "winter average" is established as per paragraph B(1)(b) above. (d) Service Area - the geographic region served by the City's wastewater system. (2) Winter Average Criteria (a) "Winter Average" charges shall apply to one -family residential customers only. (b) The "winter average" shall be based on a customer's average water consumption for three complete consecutive reading periods commencing with the customer's first reading period on or after November 15 of each year. (c) The following method will be used to calculate a customer's "winter average". (i) Add the three winter months water consumption to get total water consumption. (ii) Add the number of days in the three monthly reading cycles to get total use days. (iii) Divide total water consumption by total use days to get daily usage. (iv) Multiply daily usage amount by 91.25 (the number of days in a quarter of a year) to get three month usage (v) Divide three month usage ORD4: 91154 3 amount by 3 to get winter average usage. Such winter average usage shall be limited to a maximum of 25,000 gallons. (vi) Using the winter average usage, apply the applicable rates established in (3) below to calculate the "winter average", which will constitute the customer's bill for each month until a new average is established (or rates are changed). (d) New and Relocating Customers; Adjustments (i) Customers new to the service area and who have not established a "winter average" shall be billed at the "interim average" rate. (ii) Customers who are relocating within the service area and who established a "winter average" at their previous address shall be billed at the "interim average" rate or their "winter average" rate at the previous address, whichever is less. (iii) Customers who are relocating within the service area and who have not established a "winter average" at their previous address shall be billed at the "interim average" rate. (iv) When a customer experiences a substantial increase in water or wastewater usage from hidden water leaks in the plumbing system during the winter average charge period and if the customer can produce proof of repairs, the Director of Finance or his/her designee has the discretion to adjust the wastewater bill. ORD4: 91154 4 (e) If water conservation measures [conditions I, II, III, or IV of Section 55-151(3)] are in effect during "winter averaging wastewater charge period" a new "winter average" will not be calculated for that year. The previous "winter average" (plus any applicable rate change enacted by ordinance) will be in effect until such time that no water conservation condition remains in effect and a new "winter averaging wastewater charge period" is completed. The new "winter average" will be effective with billings on or after the June 1 following the "winter averaging wastewater charge period". (3) Administrative change in rates (a) As soon as practical, the City Manager shall calculate accrued revenues from single-family residential wastewater customers for May 1, 1992 through April 30, 1993 (the "Base Revenues"). (b) In order to convert to the winter averaging system enacted herein, the City Manager shall, based upon the Winter Average wastewater usage determined during the Winter Averaging Wastewater Charge Period, adjust the rate applied to each customer's winter average or interim average so that the Adjusted Rate will produce an amount equal to the Base Revenues. (c) The City Manager shall implement the Adjusted Rate effective June 1, 1993. (d) Each year after 1993, the City Manager shall perform the calculations for Base Revenues and Winter Averages described in parts (a) and (b) of this subsection. Adjusted rates shall then be established for that year as provided in part (c). SECTION 2. That all ordinances and parts of ordinances in conflict herewith be and the same are hereby repealed to the extend of such conflict. SECTION 3. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 4. Unless otherwise provided, the rates and charges established in this ordinance shall take effect and be applied against all wastewater service provided on ORD4: 91154 5 or after July 30, 1992. SECTION 5. Publication shall be made in the official publication of the City of Corpus Christi as required by the City Charter of the City of Corpus Christi.
