HomeMy WebLinkAbout021445 RES - 07/28/1992RESOLUTION Cross Connection Control Whereas, The City Council is concerned about the health and safety of the citizens of Corpus Christi and its surrounding communities; and Whereas, The Texas Water Commission on March 1, 1992 assumed the powers, duties, rights and obligations of the Texas Department of Health pertaining to the setting of standards for drinking water and the protection of public water supplies; and Whereas, The Texas Water Commission on April 1, 1992 adopted emergency Rules and Regulations for Public Water Systems pertaining to the setting of standards for potable water and the protection of public water supplies, to be in effect for 120 days at which time final rules will be adopted; and Whereas, Rule 31 TAC 290.44, (h), (2) Water Distribution, Backflow, siphonage allows the use of heat exchange systems that return "used" water to the public drinking water system which constitutes a Cross Connection, a physical connection between a potable water supply and an unknown supply; and Whereas, the Environmental Protection Agency has advised the Texas Water Commission to reconsider the State's position regarding Rule 31 TAC 290.44, (h), (2); and Whereas, the Environmental Protection Agency has advised the Texas Water Commission that Cross Connections, are prohibited by virtually every State and are acknowledged as the most common cause of accidental contamination of potable water systems, that the public water utility loses control of the sanitary quality of the water through heat exchangers and that the addition of heat to water can deplete the disinfectant residuals in potable water which serve to inhibit bacterial growth; and Whereas, the American Water Works Association has advised Governor Ann Richards that the people most at risk from Cross Connections are children, the elderly and infirm, and those whose resistance is low due to illnesses; and NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF CORPUS CHRISTI TEXAS: Section 1: That the City Council support the Environmental Protection Agency, municipalities throughout Texas, the American Water Works Association and the Association of Metropolitan Water Agencies by requesting that the Texas Water Commission ban the return of "used" water into the public drinking water system. 021445 Section 2: That the City Secretary is instructed to send resolution to the Texas Water Commission, Governor Ann Richards, State Truan, State Senator Kenneth Armbrister, State Senator Judith Representative Hugo Berlanga, State Representative Eddie Cavazos, State Todd Hunter, and State Representative Steve Holzheauser.
