HomeMy WebLinkAbout021466 ORD - 08/25/1992AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION BY STORY FARMS, INC. BY GRANTING A SPECIAL PERMIT FOR A FUNERAL HOME SUBJECT TO FOUR (4) CONDITIONS ON LOT 9A, BLOCK 5, SHERWOOD PARK; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Story Farms, Inc. for amendment to the zoning map of the City of Corpus Christi. WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Tuesday, August 25, 1992 during a meeting of the City Council in the Council Chambers at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. ORD 5: 91167 021466 MIGROEILMED SECTION 2. That a Special Council Permit be granted on Lot 9A, Block 5, Sherwood Park located on the southeast side of Weber Road, approximately 140 feet northeast of Redwood Street, in the City of Corpus Christi, Nueces County, Texas, for a funeral home subject to the following conditions, according to the site plan, and subject to all other considerations of "AB" Professional Office District: 1. USE: The only use authorized by this Special permit other than the basic "AB" Professional Office District uses, is a funeral home. The funeral home use and its accessory uses and structures are limited to the northwest 215 feet as measured from the Weber Road southeast right-of-way line. 2. STANDARD SCREENING FENCE: A standard screening fence shall be installed and maintained as follows: (a) In an area parallel to and set back at least 25 feet from the Chester Drive right-of-way line; and (b) Along the adjacent residential property lines; as required in Section 27-3.01.06 of the Corpus Christi Zoning Ordinance; The fence(s) must be installed before a certificate of occupancy is issued. 3. LANDSCAPING. A landscape area with a minimum width of 25 feet must be provided along the Chester Drive right-of-way line. The landscape area must contain at least six (6) live oak trees with a minimum caliper of 21 inches, to be distributed evenly along the Chester Drive frontage. All landscaping must be installed before a certificate of occupancy is issued. 4. DRIVEWAYS: No driveway or vehicular access shall be permitted from Chester Drive. In the event the Board of Adjustment grants any special exception or variance to the Zoning Ordinance, applicable to the Special Permit herein granted, other than the one specified in this Special Permit, said Special Permit shall be void and of no force and effect whatsoever. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby amended as herein ordained. ORD 5: 91167 If -1 T SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. To the extent that the amendment to the Zoning Ordinance set forth hereinabove represents a deviation from the Comprehensive Plan, the Comprehensive Plan is hereby amended to conform to the Zoning Ordinance as amended herein. SECTION 7. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at three regular meetings so that this ordinanye is passe and shall take effect upon first reading as an emergency measure this the ! , day of ( ti • , 1991 Al 1'EST: A/4”4Q.
