HomeMy WebLinkAbout021511 RES - 11/03/1992r RESOLUTION AUTHORIZING AMENDMENT NO. 1 TO THE ENGINEERING SERVICES CONTRACT WITH ORIGINAL JOINT VENTURE OF MUNROE AND BASS, INC., ASSOCIATED ENGINEERS AND SURVEYORS, AND WELSH ENGINEERING PROVIDING FOR REDESIGN SERVICES OF OFF-SITE CHANNEL "A" FOR A FEE OF $28,000, AND FOR CONSTRUCTION PHASE SERVICES FOR A FEE OF $165,940. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager or his Designee be authorized to execute Amendment No. 1 to Engineering Services Contract with original joint venture of Munroe and Bass, Inc., Associated Engineers and Surveyors, and Welsh Engineering providing for redesign services of off-site Channel "A" for a fee of $28,000, and for construction phase services for a fee of $165,940, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A". BRAY, JR., CITY ATTORNEY By: , f Lao* r Assistant AG5000.235.ajr ity Attorney 021511 liteli4u4ED AMENDMENT NO. 1 TO CONTRACT FOR ENGINEERING SERVICES STATE OF TEXAS § COUNTY OF NUECES § Whereas the City of Corpus Christi ("City") entered into that certain contract for engineering services with a joint venture comprised of Munroe and Bass, Inc., Associated Engineers and Surveyors, and Welsh Engineering ("original joint venturers") dated September 22, 1988 for the reconstruction and widening of Waldron Road, from South Padre Island Drive to Purdue Road, and with related sanitary sewer, water and drainage improvements, said contract hereinafter referred to as "original contract"; WHEREAS Murray Bass, Jr., Consulting Engineers, Inc., is the successor firm to Munroe and Bass, Inc., and; WHEREAS Welsh Engineering and Murray Bass, Jr., Consulting Engineers, Inc. have merged together to form a new engineering firm called Bass & Welsh Engineering, Inc., and; WHEREAS the joint venture of Bass & Welsh Engineering and Associated Engineers and Surveyors ("Engineers") are successors in interest and obligations of original joint venturers under said original contract; NOW, therefore, and in consideration of the fees to be paid by City to Engineers as described below, City and Engineers agree that Engineers are to perform and complete all remaining work not accomplished and completed by original joint venturers under said original contract and City and Engineers agree to the following changes to said original contract: II. SCOPE OF SERVICES A. Under II. "Scope of Services" of said original contract delete sub -paragraph C.4 and substitute the following: Part A - General Construction Surveying Services C.4 Provide all of the surveying services as follows: Amendment No. 1 to Contract for Engineering Services Joint Venture - Munroe & Bass, Inc., Associated Engineers & Surveyors and Welsh Engineering October 22, 1992; Page 1 of 6 i a. Recover or re-establish all centerline control data used in the preparation of the plans and specifications as required. Provide bench marks at 500' intervals. Provide right-of-way line stakes at 100' intervals (accuracy +/-0.2 feet). b. Survey and stake all sanitary sewer gravity and force mains on an offset line at 100' on centers with horizontal and vertical control. Survey, stake and provide horizontal and vertical control for all manholes, lift station, and force main fittings. c. Survey and stake all waterline improvements on an offset line with stakes a minimum of 100' on centers with horizontal and vertical control and stake location, horizontal and vertical, of all fire hydrants, valves and fittings. d. Survey and stake all storm sewer improvement pipes and concrete - lined channels on an offset at 50' intervals, and open channels on an offset at 100' intervals with horizontal and vertical control. Survey and stake all inlets and manholes with horizontal and vertical control. Survey and stake bridges and box culverts with the centerline axis in both directions and a bench mark at the site. e. Survey and stake street improvements rough -cut stakes on one side of street at 100' on center with horizontal and vertical control. Survey and verify top of subgrade at the 1/4 points and centerline prior to stabilization or placement of concrete pavement. For the construction of the curb and gutter, survey and stake a line of stakes 3' behind each curb at 50' on center, plus grade breaks with horizontal and vertical control. Survey and stake the radius point for all curb returns and points of curvature for driveways, at the curb line. It is the intent of this paragraph to require Engineers to provide all the construction survey services described in Item A-12. Construction Staking, of the project's Special Provisions of the Specifications for the completion of the project. Part B - Pipeline Related Construction Surveying Services The Engineers, in conjunction with petroleum pipeline adjustments, shall stake, on the ground, all of the pipelines at right-of-way line crossings of Waldron Road and offsite drainage channels on an on-call basis as requested by the contractor. The purpose of this is so that the contractor can locate and expose for pipeline company to test and isolate approximately 47 petroleum pipelines from the several rights-of-way, prior to contractor removal. Amendment No. 1 to Contract for Engineering Services Joint Venture - Munroe & Bass, Inc., Associated Engineers & Surveyors and Welsh Engineering October 22, 1992; Page 2 of 6 Part C - Final Survey Services Engineers shall survey the entire project after all work is completed to obtain the following "As -built" information, and verify final project quantities. a. Manholes (Sanitary and Storm Sewer). Elevation of rim and invert. b. Measure driveways, sidewalk, curb and gutter, pavements and pavement markings. c. Locate all fire hydrants and waterline valves. d. Locate all Force Main Valves. B. Under II. "SCOPE OF SERVICES" of said original contract, delete from sub -paragraph C.5., the following: "Day -to -Day inspection services shall be provided by the City as is customary for infrastructure construction which will be maintained by the City.", and add the following to said sub -paragraph C.5: Full -Time Resident Services Engineers shall provide full-time resident inspection services for the project duration. The City reserves the right to approve the Engineers' resident inspection personnel but such approval shall not be unduly withheld. At a minimum, resident inspection personnel shall have significant experience in street, drainage, water and wastewater construction comparable to size and scope of project. Engineers shall: 1. Provide full-time resident inspection personnel and services for all phases of inspection at all times the contractor is actively working on the project, provide detailed daily reports of construction activity, and mark up project plan prints with as -built changes and notes. 2. Supervise and direct the work of field staking and inspection. 3. Normal day-to-day detailed coordination with Engineering and respective City utilities staff and with the testing laboratory as needed. 4. Testing services are not included. It is contemplated that the City will engage and pay directly a commercialtesting laboratory for such tests as are not the responsibility of the construction contractor. "SCOPE OF SERVICES" of said original contract, add paragraph H. Channel "A" Re -Alignment, as follows: H. Channel "A" Re -Alignment Redesign Services Re -design offsite drainage Channel "A" (as designated in the preliminary engineering report submitted to the City under said original contract and in the construction plans as originally submitted such that offsite drainage Channel "A" would begin at Waldron Road, thence extending in a southeasterly direction parallel to Graham Road to the northwest boundary line of Lot 10, Section 55, Flour Bluff and Encinal Farm and Garden Tracts (Exxon Company, U.S.A.) at the easternmost corner of Wranosky Park; thence along, adjacent to and northwest of said northwest boundary line of said Lot 10; thence southwest of, adjacent to and generally parallel with the southwest boundary line of Gateway Park residential subdivision, crossing Laguna Shores Road to the Laguna Madre. 1. Preliminary Work A. Preliminary Cost Estimate on re-routing Channel "A" to the north. B. Hydraulics calculations. C. Bridge and right-of-way sizing calculations. D. Preparation of metes and bounds descriptions for re-route and drawings associated herewith. E. Corps of Engineers permit amendment application, correspondence and site visits with Corps of Engineers and governmental agencies. F. Preparation of exhibits for negotiations with pipeline companies. G. Meetings, correspondence and site visits with City with regard to Corps of Engineers permit. H. Boundary surveying for metes and bounds descriptions. Preparation of construction plans for re-routing offsite drainage Channel "A" and wastewater force main. B. Re-siting lift station and design of access road through Wranosky Park and extension of culvert and waterline in Wranosky Park. C. Re -design the Laguna Shores Road drainage crossing for offsite channel "A". D. Topographic survey along the new route to Channel "A". E. Negotiations, meetings and correspondence with Reynolds, Exxon and Petrotex with regard to locating pipelines and adjustments therefor and for negotiating contracts between the City and pipeline companies for construction adjustment work. Provide survey field work as required to tie in pipelines for agreements. III. FEE Under III. FEE, of said original contract add paragraph C. Fee and Payment This Amendment. C. Fee and Payment This Amendment 1. Part A. General Construction Surveying Services: The fee for general construction surveying services shall be a fixed fee of $33,120. Payment shall be made based on the percentage completion of the construction contract. Part B. Pipeline Related Construction Surveying Services: The fee for pipeline related construction surveying services shall be $255 per pipeline crossing actually staked on the ground, not to exceed a total sum of $12,000. Payment shall be made based on the actual pipeline crossings actually staked on the ground according to invoices submitted on a monthly basis as work progresses. Part C. Final Survey Services: The fee for final survey services shall be a fixed fee of $8,500. Payment shall be made upon completion and acceptance of the construction contract. The fee for full-time Resident Inspection Services shall be a fixed fee of $112,320. Payment shall be made based on percentage completion of the construction contract. 3. The fee for Channel "A" Re -Alignment Redesign Services shall be a fixed fee of $28,000. Payment shall be made within two weeks of date hereof. Said fees shall be in addition to the $6,000 fee as described in Paragraph "E". Special Services, of said original contract and in addition to the $335,000 fee described under Section III. FEE, of said original contract. All other terms and conditions of said original contract not specifically addressed herein, shall remain in full force and effect.
