HomeMy WebLinkAbout021587 ORD - 03/09/1993i AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDMENT TO LICENSE (LEASE) NO. DOT-FA78SW-1073 WITH THE U. S. DEPARTMENT OF TRANSPORTATION, FEDERAL AVIATION ADMINISTRATION, ADDING 400 FEET BY 1600 FEET AT THE END OF RUNWAY 31 FOR THE INSTALLATION, OPERATION, AND MAINTENANCE OF THE MEDIUM INTENSITY APPROACH LIGHTING SYSTEM/RUNWAY ALIGNMENT INDICATOR LIGHT. WHEREAS, City Council authorized License DOT-FA78SW-1073 with the U. S. Department of Transportation, Federal Aviation Administration (FAA) on June 25, 1980, by Ordinance No. 15606; amended on August 22, 1981, by Ordinance No. 16471 1/2; amended on July 24, 1984, by Ordinance No. 18356; amended on April 29, 1986, by Ordinance No. 19284; and amended on July 5, 1988, by Ordinance No. 20364; and WHEREAS, the FAA requires the City to provide additional leased area for the installation, operation, and maintenance of the Medium Intensity Approach Lighting System/Runway Alignment Indicator Light (MALSR). NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the License DOT-FA78SW-1073 be amended by Supplemental Agreement No. 5, a copy of which is attached and incorporated as Exhibit A, to add 400 feet wide by 1600 feet long beginning at the end of Runway 31, as shown on Drawing No. CRP- MALSR-G02, a copy of which is attached and incorporated as Exhibit B, to the property held by FAA under License No. DOT- FA78SW-1073 in accordance with the restrictions set out on Exhibit B. All other terms and conditions of License No. DOT- FA78SW-1073, as amended, are hereby ratified and remain the same. \ord\93009.skp 4140% 1 1 T "'slum-TItikPAW 021587 DEPARTMENT OF TRANSPORTATION FEDERAL AVIATION ADMINISTRATION SOUTHWEST REGION FORT WORTH, TEXAS 76193-0056 License No. DOT-FA78SW-1073 Medium Intensity Approach Lighting System w/ Runway Alignment Indicator Lights (MALSR), Localizer, Runway 31, MALSR, Visual Approach Slope Indicator (VASI), Runway Visual Range (RVR), Runway 13, International Airport, Corpus Christi, Texas SUPPLEMENTAL AGREEMENT NO. 5 THIS SUPPLEMENTAL AGREEMENT, made and entered into this day of 19_ by and between the CITY OF CORPUS CHRISTI, TEXAS, whose address is 1000 International Drive, Corpus Christi, Texas 78406-1801 for itself, its successors and assigns, hereinafter called the Lessor, and the UNITED STATES OF AMERICA, represented by the Federal Aviation Administration, hereinafter referred to as the Government, WITNESSETH, That: WHEREAS, on the 27th day of June 1980, the parties hereto entered into License DOT-FA78SW-1073, as amended by Supplemental Agreement Nos. 1, 2, 3, and 4, dated August 22, 1981, July 26, 1984, April 29, 1986, and July 5, 1988, respectively, for the consideration and purposes more particularly stated in said lease, as amended; and, WHEREAS, the Government has an operational requirement to replace the existing Medium Intensity Approach Lighting System, Runway 31 with a Medium Intensity Approach Lighting System/Runway Alignment Indicator Light (MALSR), Runway 31, at International Airport, Corpus Christi, Texas; and, WHEREAS, the Government has a requirement for the city to provide additional leased area for the Runway 31, MALSR, as shown on the enclosed Drawing No. CRP-MALSR-G02. NOW, THEREFORE, effective October 1, 1992, the parties hereto mutually agree to amend the basic lease, as amended, in the following particulars only, VIZ: The Lessor grants the Government a site upon which to install, operate, and maintain a MALSR on Runway 31, in accordance with Drawing No. CRP-MALSR-G02, dated April 7, 1992, and restrictions thereon, attached hereto and made a part hereof. ALL OTHER TERMS AND CONDITIONS of the basic lease, as amended, are hereby ratified and except as amended hereinabove shall be and remain the same.
