HomeMy WebLinkAbout021625 ORD - 04/06/1993AN ORDINANCE CALLING A RUNOFF ELECTION FOR COUNCIL MEMBER DISTRICT 2 AND COUNCIL MEMBER DISTRICT 3, IN THE CITY OF CORPUS CHRISTI, TEXAS, TO BE HELD ON THE 17TH DAY OF APRIL, 1993; DESIGNATING POLLING PLACE LOCATIONS FOR SUCH ELECTION; ENACTING PROVISIONS INCIDENT AND RELATING TO THE SUBJECT AND PURPOSE OF THIS ORDINANCE; AND DECLARING AN EMERGENCY. WHEREAS, the regular City election for Mayor and eight (8) Council Members in the City of Corpus Christi was held on April 3, 1993, in accordance with law; WHEREAS, the official canvass of said the election reveals that none of the candidates for the offices of Council Member District 2 and Council Member District 3 received the number of votes required for election; and WHEREAS, Article II, Section 3, of the City Charter sets the runoff election for the second Saturday following the regular election. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS; SECTION 1. That a runoff election for the offices of Council Member District 2 and Council Member District 3, in the City of Corpus Christi, shall be held in the City of Corpus Christi on April 17, 1993, with the names of the following candidates for the respective office as follows: Council Member, District 2 Cezar Galindo J. C. "Jim" Hawkins Council Member, District 3 David Noyola Jack Baker SECTION 2. That at said election herein ordered all the qualified voters of the City of Corpus Christi eligible to vote in the runoff election shall be permitted to vote. SECTION 3. That the names of candidates for said office shall be placed on said ballot in the manner and form prescribed by law. SECTION 4. That voting machines shall be employed at the election herein ordered in accordance with the provision of the \ord\93023.akp 021625 tilicathemth Election Code, and said election shall be held at the polling places in the regularly prescribed precincts of the City of Corpus Christi, such voting precincts and polling places being set forth on Attachment A hereto, incorporated by reference and made a part of this ordinance. Said election shall be held in accordance with the election laws of the State of Texas. The polls shall be open from 7:00 a.m. to 7:00 p.m. on the day of the election. SECTION 5. The City Secretary shall conduct the election as directed by resolution of the City Council and by law. SECTION 6. Voting machines shall be used for the conduct of said election on election day and paper ballots shall be used for conducting early voting. Early voting in person shall be conducted from 6:00 a.m. to 5:00 p.m. Monday, April 12, 1993 and Tuesday, April 13, 1993. Early voting in person may be conducted at the main early polling place located in the lobby of City Hall, adjacent to the office of the City Secretary, 1201 Leopard, or at the temporary branch polling places in Corpus Christi hereby established as follows: 901 Leopard 4040 Greenwood 5151 McArdle Nueces County Courthouse Greenwood Sr. Citizen Center C.C. Area Council for the Deaf Each branch polling place and the main early polling place shall serve all election precincts. SECTION 7. The City Secretary is directed to post and publish such election notices as are required by the Election Laws of the State of Texas. SECTION 8. By approving and signing this ordinance, the Mayor officially confirms as her action all matters recited in this ordinance which by law come within her jurisdiction. SECTION 9. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purposes. SECTION 10. The fact that it is necessary and essential that a runoff election for the election of the above specified officers of the City of Corpus Christi shall be held on the 17th day of April, 1993, and all related actions be expeditiously accomplished, and immediate action is necessary for the efficient and effective administration of the City's affairs to comply with all applicable laws, creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance \ord\93023. ekp shall be passed finally on the date of its introduction but that such ordinance shall be read at three regular meetings of the City Council, and the Mayor, having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from ani #f ter its passa , IT_ S ACCORDINGLY SO ORDAINED, this the r - day of , 1993.
