The resolutions/ordinances have been renumbered, and the corrected copies are on file in the City Secretary's Office: WAS DESCRIPTION IS 021624 Returns and Results - April 3, 1993 021624-1/2 021610 Resolution on Landfill Regulations 021630 021611 Mercantile Bank 021631 021612 Street Closings - Naval Air Station 021632 021613 Lease - Las Carabelas 021633 V CJ's"C5)C- Armando Chapa City Secretary MICROEILMEU AN ORDINANCE CLOSING AND ABANDONING PORTIONS OF THE FOLLOWING STREETS WITHIN THE NAVAL AIR STATION CLEAR ZONES: ANCHOR STREET FROM THE NORTH LINE OF NORTHERLY HORNET STREET NORTHWARD TO DEAD-END AT THE NAVAL BASE; AVIATION DRIVE FROM 166 FEET NORTH OF NAVY DRIVE NORTHWARD TO DEAD-END AT THE NAVAL BASE; MILITARY DRIVE FROM APPROXIMATELY 100 LINEAR FEET NORTH OF NAVY DRIVE NORTHWARD TO DEAD-END AT THE NAVAL BASE; HORNET DRIVE, FROM ALLEY EAST OF ANCHOR STREET TO ALLEY WEST OF MILITARY DRIVE; NAVY DRIVE FROM MILITARY DRIVE TO THE ALLEY WEST OF MILITARY DRIVE; THE NORTH -SOUTH ALLEYS IN OR ADJACENT TO BLOCKS 6, 7, 8, 10, 11, 15, 16, AND 17, NAVAL CENTER SUBDIVISION, AND THE EAST -WEST ALLEY ALONG THE NORTH BOUNDARY OF THE J. M. WEBB AND NAVAL CENTER SUBDIVISIONS ADJACENT TO THE EXISTING U.S. NAVAL AIR STATION; ALSO CLOSING BUT RETAINING AS A UTILITY EASEMENT RIGHTS-OF-WAY ON HORNET DRIVE FROM NAS DRIVE WEST TO THE ALLEY BETWEEN BLOCKS 1 AND 4 AND BLOCKS 2 AND 3, J.M. WEBB SUBDIVISION, THE ALLEY BETWEEN NAS DRIVE AND ANCHOR STREET FROM APPROXIMATELY THE NORTHERLY LINE OF LOT 6, BLOCK 2, J.M. WEBB SUBDIVISION NORTHWARD TO DEAD- END AT THE NAVAL BASE; ANCHOR STREET FROM APPROXIMATELY 425 LINEAR FEET NORTH OF NAVY DRIVE NORTHWARD TO THE SOUTH PROPERTY LINE OF LOT 9, BLOCK 4, J.M. WEBB SUBDIVISION; AVIATION DRIVE FROM NAVY DRIVE NORTHWARD FOR A DISTANCE OF 166 LINEAR FEET TO THE NORTH PROPERTY LINE OF LOT 8, BLOCK 10, NAVAL CENTER SUBDIVISION; AND NAVY DRIVE BETWEEN MILITARY DRIVE AND THE ALLEY IN BLOCKS 15 AND 16, NAVAL CENTER SUBDIVISION; APPROVING AS CONSIDERATION OF THE FAIR MARKET VALUE THE COST SAVINGS BY NO LONGER HAVING MAINTENANCE RESPONSIBILITIES FOR THESE RIGHTS-OF- WAY; REPLATTING THE PROPERTY; MEETING SPECIFIED CONDITIONS; AND DECLARING AN EMERGENCY. WHEREAS, notice of the time and place for holding a hearing concerning: the closing of Anchor Street, Aviation Drive, Military Drive, Hornet Drive, and the north -south alleys in Blocks 6, 7, 8, 10, 11, 15, 16, and 17, Naval Center Subdivision, and the east -west alley along the north boundary of the J.M. Webb and Naval Center Subdivisions adjacent to the existing U.S. Naval Air Station; and closing, but retaining as a utility easement, portions of the rights-of-way of Hornet Drive, the alley between NAS Drive and Anchor Street, Anchor Street, Aviation Drive, and Navy Drive, was given by publication and mailed to the last known addresses of the owners of property abutting the public way and within 450 feet of the area proposed to be closed, and thereafter, pursuant to said notice, public hearing was held at a meeting of the City Council of the City of Corpus Christi on December 22, 1992, in accordance with the provisions of the City Charter; and 021632 AG5000256.ajr MiLROFILMII WHEREAS, it was determined by the City Council after such hearing that the aforesaid portions of rights-of-way, proposed to be closed, are not needed now, nor will they be within the foreseeable future needed as public rights-of-way, and that the same should revert to the abutting property owners, subject to certain specified conditions: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI: SECTION 1: That there is hereby closed and abandoned portions of the following streets within the Naval Air Station Clear Zones: Anchor Street from the north line of northerly Hornet Street northward to dead-end at the Naval Base; Aviation Drive from 166 feet north of Navy Drive northward to dead-end at the Naval Base; Military Drive from approximately 100 linear feet north of Navy Drive northward to dead-end at the Naval Base; Hornet Drive, from alley east of Anchor Street to alley west of Military Drive; Navy Drive from Military Drive to the alley west of Military Drive; the north -south alleys in or adjacent to Blocks 6, 7, 8, 10, 11, 15, 16, and 17, Naval Center Subdivision, and the east -west alley along the north boundary of the J. M. Webb and Naval Center Subdivisions adjacent to the existing U.S. Naval Air Station. SECTION 2: That there is hereby closed for street purposes, but retained for utility easements, portions of the following streets and rights-of-way within the Naval Air Station Clear Zone: Hornet Drive from NAS Drive west to the alley between Blocks 1 and 4 and Blocks 2 and 3, J.M. Webb Subdivision, the alley between NAS Drive and Anchor Street from approximately the northerly line of Lot 6, Block 2, J.M. Webb Subdivision northward to dead-end at the Naval Base; Anchor Street from approximately 425 linear feet north of Navy Drive northward to the south property line of Lot 9, Block 4, J.M. Webb Subdivision; Aviation Drive from Navy Drive northward for a distance of 166 linear feet to the north property line of Lot 8, Block 10, Naval Center Subdivision; and Navy Drive between Military Drive and the alley in Blocks 15 and 16, Naval Center Subdivision subject to the provisions listed below. SECTION 3: The above streets are hereby closed and abandoned or closed for street purposes but retained as utility easements as listed in Sections 1 and 2 subject to: 1) the applicant replatting said property within 180 days of passage of this ordinance, provided however, the City Engineer may extend the time limit for an additional one hundred (180) days if extenuating circumstances outside the applicant's control necessitate an extension; 2) applicant paying fees to either abandon -in-place or abandon and remove the water lines under the direction of the Water Division and wastewater lines under the direction of the Wastewater Division; 3) City retaining an access easement for ingress and egress to the 6 -inch high pressure gas line, 4 -inch gas main and regulator station located on Hornet Drive and the alley west of NAS Drive for maintenance; 4) applicant paying for the relocation of CP&L, Southwestern Bell, and TCI Cable facilities; AG5000256.ajr 5) City retaining an easement for Southwestern Bell aerial cable, located in the alley east of Anchor Street; and along Anchor Street north from Navy to Hornet; as well as Aviation Avenue, north of Navy to Hornet, and the far eastern block of Navy Drive for maintenance purposes; and 6) City closing, but retaining as a utility easement, portions of the rights-of-way of Hornet Drive, the alley between NAS Drive and Anchor Street, Anchor Street, Aviation Drive, and Navy Drive as set out in Section 1 above. 7) applicant assuming all rights-of-way maintenance costs, with this cost savings to the City being the fair market value consideration for these rights -if -way closures. SECTION 4.
