HomeMy WebLinkAbout021650 RES - 05/11/1993A RESOLUTION AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO EXECUTE TWO CONTRACTUAL AGREEMENTS WITH THE STATE OF TEXAS, ACTING THROUGH THE TEXAS DEPARTMENT OF TRANSPORTATION, FOR THE CONSTRUCTION OF TRAFFIC SIGNAL COORDINATION IMPROVEMENTS ALONG EVERHART ROAD AND BALDWIN BOULEVARD, WITH THE CITY'S TEN PERCENT ESCROW SHARE OF CONSTRUCTION COST ESTIMATED AT $20,970.17 FOR THE EVERHART ROAD PROJECT AND $9,079.44 FOR THE BALDWIN BOULEVARD PROJECT. WHEREAS, the Texas Department of Transportation has proposed an Escrow Account for supplying traffic signal coordination improvements on Everhart Road from State Highway No. 358 to Snowgoose Road and on Baldwin Boulevard with Ayers Street on State Highway No. 286, Port Avenue and Greenwood Drive. WHEREAS, the Department of Transportation has estimated City participation at $20,970.17 for the Everhart Road Project and $9,079.44 for the Baldwin Boulevard Project: NOW THEREFO::E, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager, or his designee, be and is hereby authorized to enter into two escrow account agreements with the Texas Department of Transportation for City's ten (10%) percent match for construction of traffic signal coordination improvements estimated at $20,970.17 for the Everhart Road Project and $9,079.44 for the Baldwin Boulevard Project,a substantial copy of which is attached and incorporated as Exhibit "An SECTION 2. That this resolution shall take effect immediately from and after its passage in accordance with the provisions of the Charter of the City of Corpus Christi and it is accordingly so resolved. Nueces County STATE OF TEXAS COUNTY OF TRAVIS THIS AGREEMENT is made this day of , 1993, by and between the City of Corpus Christi, Texas, hereinafter called the "City", Party of the First Part, acting by and through its City Council and the State of Texas, hereinafter called the "State", Party of the Second Part, acting by and through its Texas Department of Transportation Commission. WHEREAS, the City desires participation of interconnecting signals and incidental items within the limits on Everhart Road from State Highway No. 358 to Snowgoose Road. The City has requested the State to construct or have constructed this work. The State will construct or have constructed this work and the City will pay ten per cent (10%) of the construction cost of this work or that portion not reimbursable by the Federal Government. The estimated construction cost of this work, including preliminary engineering, is Two Hundred Nine Thousand Seven Hundred One and 72/100 Dollars ($209,701.72), and the City's estimated ten per cent (10%) share is Twenty Thousand Nine Hundred Seventy and 17/100 Dollars ($20,970.17). NOW THEREFORE, it is understood that this proposed work will be constructed by the State and the City will transmit to the State with the return of this agreement, executed by the City, a warrant or check made payable to the Texas Department of Transportation in the amount of Twenty Thousand Nine Hundred Seventy and 17/100 -1- HES 0005(634), Etc. 0916-35-025, Etc. Nueces County Dollars ($20,970.17), to be used in paying for the proposed work required by the City in the City of Corpus Christi. It is further understood that the State will construct only those items for the City as requested and required by the City and ten per cent (10%) of the construction costs of such items or that potion not reimbursable by the Federal Government will be borne by the City. If upon completion of construction, at receipt of bids, or at anytime, it is found that the amount previously collected is insufficient to pay the City's portion, then the City upon request of the State will forthwith supplement this amount by an amount equal to the City's actual share of the cost of this work less the amount previously paid to the Texas Department of Transportation. In the event the amount as paid is more than the actual cost, then the excess amount will be returned to the City. It is further understood that the work to be done on behalf of the City, as herein provided, will include the cost of contingencies, preliminary and construction engineering. -2- HES 000S(634), Etc. 0916-35-025, Etc.
